Title

What is the penalty for masturbating while in the state of Ihram?

Question

السلام عليكم و رحمة الله و بركاته

 

If one masturbates in the state of ihraam during en route to umrah what penalty if any becomes compulsory? Please advise

Answer

In the Name of Allah, the Most Gracious, the Most Merciful. 

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

 

In principle, if one masturbated while in the state of Ihram, then that is a major sin and a major violation of the spirit of Ihram.

 

Nevertheless, he will have to offer one sheep as a penalty for committing the evil and immoral act. He should also make a lot of Tawbah and Istighfaar for committing such an evil act in such a state.

 

Ihram means to make something prohibited. When a person enters into the state of Ihram by wearing the two pieces of cloth and reciting Talbiyah, many things become prohibited on him. He cannot cut his hair, he cannot clip his nails, he cannot use fragrance, he cannot be immoral.

 

A person in the state of Ihram ought to be guarded against committing any prohibitions in the state of Ihram. If he violates the prohibitions and restrictions, he will have to give a penalty. A person in the state of Ihram is on a high level of spirituality. His focus is seeking the forgiveness of Allah and the pleasure of Allah. It is unthinkable that a person in such a state will commit an immoral act of masturbation.

لَمَّا كَانَتْ الْجِنَايَةُ مِنْ الْعَوَارِضِ أَخَّرَهَا، وَهِيَ فِي اللُّغَةِ مَا تَجْنِيهِ مِنْ شَرٍّ أَيْ تُحْدِثُهُ تَسْمِيَةً بِالْمَصْدَرِ مِنْ جَنَى عَلَيْهِ شَرًّا، وَهُوَ عَامٌّ إلَّا أَنَّهُ خُصَّ بِمَا يَحْرُمُ مِنْ الْفِعْلِ، وَأَصْلُهُ مِنْ جَنْيِ الثَّمَرِ، وَهُوَ أَخْذُهُ مِنْ الشَّجَرِ، وَفِي الشَّرْعِ اسْمٌ لِفِعْلٍ مُحَرَّمٍ شَرْعًا سَوَاءٌ حَلَّ بِمَالٍ أَوْ نَفْسٍ إلَّا أَنَّ الْفُقَهَاءَ خَصُّوهُ بِالْجِنَايَةِ عَلَى الْفِعْلِ فِي النَّفْسِ وَالْأَطْرَافِ وَخَصُّوا الْفِعْلَ فِي الْمَالِ بِاسْمِ الْغَصْبِ وَالْمُرَادُ هُنَا خَاصٌّ، وَهُوَ مَا يَكُونُ حُرْمَتُهُ بِسَبَبِ الْإِحْرَامِ أَوْ الْحَرَمِ وَحَاصِلُ الْأَوَّلِ أَنَّهُ الطِّيبُ وَلُبْسُ الْمَخِيطِ وَتَغْطِيَةُ الرَّأْسِ أَوْ الْوَجْهِ، وَإِزَالَةُ الشَّعْرِ مِنْ الْبَدَنِ، وَقَصُّ الْأَظْفَارِ وَالْجِمَاعُ صُورَةً، وَمَعْنًى أَوْ مَعْنًى فَقَطْ وَتَرْكُ وَاجِبٍ مِنْ وَاجِبَاتِ الْحَجِّ وَالتَّعَرُّضُ لِلصَّيْدِ وَحَاصِلُ الثَّانِي التَّعَرُّضُ لِصَيْدِ الْحَرَمِ وَشَجَرِهِ
