Title

Nafl Qurbani - Can two persons purchase & sacrifice one sheep?

Question

Assalamu Alaykum Warahmatullahi Wabarakaatuhum

Making dua Mufti Saheb is in good health

Mufti Saheb can 2 persons put monies together to buy a sheep with the niyaat for Nabi Sallallahu Alayhi Wasallam

Answer

Wa Alaykumus Salaam Wa Rahmatullahi Wa Barakaatuh

In the Name of Allah, the Most Gracious, the Most Merciful.

 Respected brother in Islam ,

In principle, one sheep for a Wajib Qurbani  can be sacrificed only on behalf of one person. One sheep for a Wajib Qurbani cannot be sacrificed on behalf of two or more persons. 1

However , one sheep for Nafl Qurbani  may be sacrificed by two or more persons for  Isaale Sawaab.  2

This is the opinion of Hazrat Mufti Mahmood ul Hasan Gangohi (رحمه الله).

وَلَا تجوز الشَّاة عَن أَكثر من الْوَاحِد وَإِن كَانَت عَظِيمَة قيمتهَا قيمَة شَاتين لِأَن الْقرْبَة إِرَاقَة الدَّم وَذَلِكَ لَا يتَفَاوَت

وَهُوَ مَا رُوِيَ عَنْ «جَابِرٍ - رَضِيَ اللَّهُ عَنْهُ - أَنَّهُ قَالَ نَحَرْنَا مَعَ رَسُولِ اللَّهِ - صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ - الْبَقَرَةَ عَنْ سَبْعَةٍ وَالْبَدَنَةَ عَنْ سَبْعَةٍ»، وَلَا نَصَّ فِي الشَّاةِ فَبَقِيَ عَلَى أَصْلِ الْقِيَاسِ

Hazrat Mufti Mahmud Sb , Hazrat Mufti Abdur Raheem Sb Lajpuri , Hazrat Mufti Nizamudeen Sb all hold this opinion and  have  given Fatwa on this :-

ایک حصہ میں سب شریک رہے ، اورایک حصہ سے واجب اداکرنا مقصود نہیں،بلکہ ثواب پہنچانا مقصود ہے ، توشرعاً اس میں کچھ حرج نہیں ہے

² كلام الشيخ نظام الدين رحمه الله :

          سوال :   اگر فوت شدہ عزیزوں یا اہل بیت یا خاص رسول اللہ صلی اﷲ علیہ وسلم کی طرف سے قربانی کی جاوے تو اس کا کیا طریقہ ہے، آیا مثل دیگر شرکاء ہر ایک شخص کی طرف سے ایک ایک حصہ ہی میں چند کو شریک کردے، فقط؟

           الجواب:  ایک ہی میں سب کو ثواب بخش سکتے ہیں ۔ فقط تاریخ بالا (تتمہ خامسہ 75) میں نے گذشتہ سال زبانی فتویٰ دیا تھا کہ جس طرح اپنی طرف سے قربانی کرنے میں ایک حصہ دو شخصوں کی طر ف سے جائز نہیں ، اسی طرح غیر کی طرف سے تبرعًا نفل قربانی کرنے میں خواہ زندہ کی طرف سے یا میّت کی طرف سے، ایک حصہ دو شخص کی طرف سے جائز نہیں ، مگر روایات سے اس کے خلاف ثابت ہوا اس لئے میں اس سے رجوع کرکے اب فتویٰ دیتا ہوں ، کہ جو قربانی دوسرے کی طرف سے تبرعًا  کی جاوے چونکہ وہ ملک ذابح کی ہوتی ہے، اور صرف اس دوسرے کو ثواب پہنچتا ہے، اس لئے ایک حصہ کئی کی طرف سے بھی ہوسکتا ہے، جیسا کہ مسلم میں ہے کہ اپنی طرف سے ایک حصہ قربانی کرکے متعدد کو ثواب پہنچانا جائز ہے ، پس یہ بھی ویسا ہی ہے

(درمختار مع الشامی ۵/۲۸۴ کتاب الا ضحیۃ)

إن مات أحد السبعة المشتركين في البدنة وقال الورثة: اذبحوا عنه وعنكم، صح عن الكل استحسانا لقصد القربة من الكل، ولو ذبحوها بلا إذن الورثة لم يجزهم
