Question

Is it permissible to donate blood plasma?

Answer

In the Name of Allah, the Most Gracious, the Most Merciful. 

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh. 

 

Blood Plasma is the translucent component of blood that remains once all white blood cells, red blood cells, platelets and other cellular components have been removed. Plasma is a “transporting medium” that works to clot blood and fight illness within the body.[i][i]

 

Patients who have recovered from a virus, develop antibodies in the blood against the virus. Therefore, the blood plasma from patients recovered from a virus, could be used as treatment for those who in future could potentially be afflicted with the same virus’.[ii][ii]

 

In order for us to understand the ruling of donating blood plasma, we must first understand the ruling regarding blood donations.

 

The default position in relation to blood donations is, it is not permitted because

  1. blood is part of the human body and therefore regarded sacred
  2. blood is impure and to take benefit from anything impure is impermissible[iii][iii]

    However, scholars have granted permissibility for blood donations based on the principal, ‘necessity relaxes prohibition’. [iv][iv]

     

    In the context of blood, necessity is gauged by fulfilling the following conditions,
  1. There is a desperate need to donate blood;
  2. There is no other alternative; and
  3. This has been prescribed by an expert medical practitioner.

     

    If the aforementioned conditions are met it will be permissible to donate blood.

     

    Since, blood plasma is a component of blood and has similar demands the same rule will apply, and it will be permissible to donate blood plasma provided the aforementioned conditions are fulfilled.

وَالِاسْتِشْفَاءُ بِالْحَرَامِ جَائِزٌ عِنْدَ التَّيَقُّنِ لِحُصُولِ الشِّفَاءِ فِيهِ، كَتَنَاوُلِ الْمَيْتَةِ عِنْدَ الْمَخْمَصَةِ، وَالْخَمْرِ عِنْد الْعَطَشِ، وَإِسَاغَةِ اللُّقْمَةِ وَإِنَّمَا لَا يُبَاحُ بِمَا لَا يُسْتَيْقَنُ حُصُولُ الشِّفَاءِ بِهِ، ثُمَّ عِنْدَ أَبِي يُوسُفَ يُبَاحُ شُرْبُهُ لِلتَّدَاوِي لحديث العرنيين، وَعِنْدَ أَبِي حَنِيفَةَ لَا يُبَاحُ؛ لِأَنَّ الِاسْتِشْفَاءَ بِالْحَرَامِ الَّذِي لَا يُتَيَقَّنُ حُصُولُ الشِّفَاءِ بِهِ حَرَامٌ، وَكَذَا بِمَا لَا يُعْقَلُ فِيهِ الشِّفَاءُ وَلَا شِفَاءَ فِيهِ عِنْدَ الْأَطِبَّاءِ، وَالْحَدِيثُ مَحْمُولٌ عَلَى أَنَّهُ - صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ - عَرَفَ شِفَاءَ أُولَئِكَ فِيهِ عَلَى الْخُصُوصِ وَاَللَّهُ أَعْلَمُ.

مَطْلَبٌ فِي التَّدَاوِي بِالْمُحَرَّمِ (قَوْلُهُ وَرَدَّهُ فِي الْبَدَائِعِ إلَخْ) قَدَّمْنَا فِي الْبَيْعِ الْفَاسِدِ عِنْدَ قَوْلِهِ وَلَبَنُ امْرَأَةٍ أَنَّ صَاحِبَ الْخَانِيَّةِ وَالنِّهَايَةِ اخْتَارَا جَوَازَهُ إنْ عَلِمَ أَنَّ فِيهِ شِفَاءً وَلَمْ يَجِدْ دَوَاءً غَيْرَهُ قَالَ فِي النِّهَايَةِ: وَفِي التَّهْذِيبِ يَجُوزُ لِلْعَلِيلِ شُرْبُ الْبَوْلِ وَالدَّمِ وَالْمَيْتَةِ لِلتَّدَاوِي إذَا أَخْبَرَهُ طَبِيبٌ مُسْلِمٌ أَنَّ فِيهِ شِفَاءَهُ وَلَمْ يَجِدْ مِنْ الْمُبَاحِ مَا يَقُومُ مَقَامَهُ، وَإِنْ قَالَ الطَّبِيبُ يَتَعَجَّلُ شِفَاؤُك بِهِ فِيهِ وَجْهَانِ، وَهَلْ يَجُوزُ شُرْبُ الْعَلِيلِ مِنْ الْخَمْرِ لِلتَّدَاوِي فِيهِ وَجْهَانِ، وَكَذَا ذَكَرَهُ الْإِمَامُ التُّمُرْتَاشِيُّ وَكَذَا فِي الذَّخِيرَةِ وَمَا قِيلَ إنَّ الِاسْتِشْفَاءَ بِالْحَرَامِ حَرَامٌ غَيْرُ مُجْرًى عَلَى إطْلَاقِهِ وَأَنَّ الِاسْتِشْفَاءَ بِالْحَرَامِ إنَّمَا لَا يَجُوزُ إذَا لَمْ يَعْلَمْ أَنَّ فِيهِ شِفَاءً أَمَّا إنْ عُلِمَ وَلَيْسَ لَهُ دَوَاءٌ غَيْرَهُ يَجُوزُ وَمَعْنَى قَوْلِ ابْنِ مَسْعُودٍ - رَضِيَ اللَّهُ عَنْهُ - لَمْ يُجْعَلْ شِفَاؤُكُمْ فِيمَا حُرِّمَ عَلَيْكُمْ يَحْتَمِلُ أَنْ يَكُونَ قَالَ ذَلِكَ فِي دَاءٍ عَرَفَ لَهُ دَوَاءً غَيْرَ الْمُحَرَّمِ لِأَنَّهُ حِينَئِذٍ يَسْتَغْنِي بِالْحَلَالِ عَنْ الْحَرَامِ وَيَجُوزُ أَنْ يُقَالَ تَنْكَشِفُ الْحُرْمَةُ عِنْدَ الْحَاجَةِ فَلَا يَكُونُ الشِّفَاءُ بِالْحَرَامِ وَإِنَّمَا يَكُونُ بِالْحَلَالِ اهـ نُورُ الْعَيْنِ مِنْ آخِرِ الْفَصْلِ التَّاسِعِ وَالْأَرْبَعِينَ

وَتَتَعَلَّق بِهَا قَوَاعِدُ: الْأُولَى: الضَّرُورَاتُ تُبِيحُ الْمَحْظُورَاتِ،

وَمِنْ ثَمَّ جَازَ أَكْلُ الْمَيْتَةِ عِنْدَ الْمَخْمَصَةِ، وَإِسَاغَةُ اللُّقْمَةِ بِالْخَمْرِ، وَالتَّلَفُّظُ بِكَلِمَةِ الْكُفْرِ لِلْإِكْرَاهِ وَكَذَا إتْلَافُ الْمَالِ، وَأَخْذُ مَالِ الْمُمْتَنِعِ الْأَدَاءِ مِنْ الدَّيْنِ بِغَيْرِ إذْنِهِ وَدَفْعُ الصَّائِلِ، وَلَوْ أَدَّى إلَى قَتْلِهِ.
