Title

Can you take Qisaas using fire?

Question

1. Is it permissible to burn a person in a case of Qisas despite the prohibition of burning people mentioned by the Prophet sallallahu alayhi wa salam in the hadith.

Answer

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

If a person has been killed unjustly, then Qisaas will be applied to the murderer.[i] Qisas will only be carried out with the sword[ii] because of the Hadith of Nabi Salallahu ‘Alayhi wa Sallam[iii]:

 لَا قَوَدَ إِلَّا بِالسَّيْفِ

“Retaliation can only be done with the sword”

It is not permissible to apply Qisaas by burning the murderer based on the Hadith[iv]:

وَإِنَّ النَّارَ لاَ يُعَذِّبُ بِهَا إِلَّا اللَّهُ

“And only Allah can punish with fire”

وَلَا يُسْتَوْفَى الْقِصَاصُ إلَّا بِالسَّيْفِ وَنَحْوِهِ كَذَا فِي الْكَافِي حَتَّى إنَّ مَنْ حَرَقَ رَجُلًا بِالنَّارِ، أَوْ غَرَّقَهُ بِالْمَاءِ تُضْرَبُ عِلَاوَتُهُ بِالسَّيْفِ، وَكَذَلِكَ إذَا قَطَعَ طَرَفَ إنْسَانٍ وَمَاتَ تُحَزُّ رَقَبَتُهُ بِالسَّيْفِ، وَلَا يُقْطَعُ طَرَفُهُ، وَكَذَلِكَ إنْ شَجَّهُ هَاشِمَةً، وَمَاتَ تُقْطَعُ عِلَاوَتُهُ بِالسَّيْفِ هَكَذَا فِي مُحِيطِ السَّرَخْسِيِّ

عَنْ أَبِي هُرَيْرَةَ رَضِيَ اللَّهُ عَنْهُ، أَنَّهُ قَالَ: بَعَثَنَا رَسُولُ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ فِي بَعْثٍ فَقَالَ: «إِنْ وَجَدْتُمْ فُلاَنًا وَفُلاَنًا فَأَحْرِقُوهُمَا بِالنَّارِ»، ثُمَّ قَالَ رَسُولُ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ حِينَ أَرَدْنَا الخُرُوجَ: «إِنِّي أَمَرْتُكُمْ أَنْ تُحْرِقُوا فُلاَنًا وَفُلاَنًا، وَإِنَّ النَّارَ لاَ يُعَذِّبُ بِهَا إِلَّا اللَّهُ، فَإِنْ وَجَدْتُمُوهُمَا فَاقْتُلُوهُمَا»
