Title

200-dollar reward from chase bank and cash back rewards. Can i accept it?

Question

Asalaamulakum respected Muft Saab,

I have opened an account with Chase bank along with a credit card facilitiy:

 

1.  Bank is offering a $200 reward when account is opening as long as you get your paycheck directly deposited to this account and as long as the value of the direct deposits from employer meet a min value within 3 months.  can i accept this reward? 

2. the credit card facility offers a 1.5% cash back for all purchases made with this card, which are credited in points and can be redeemed by purchasing other items or credit cash towards the credit card balance.  can i accept this reward?

In the name of Allah, Most Gracious, Most Merciful 
As-salaamu ‘alaykum wa-rahmatullaahi wa-barakaatuh

 

1.     It is permissible for you to accept the 200-dollars reward from the bank. You may refer to our detailed Fatwa on cash back on:

2.       The reward/loyalty points (redeemable for cash, permissible gifts, mileage, etc.) offered by some credit card companies are permissible.

As such, both cases fall under the category of Hibah (gift) and serves as an incentive for the customer from the bank. [i]

الهبة تصح بالإيجاب والقبول، وتتم بالقبض، فإذا قبض الموهوب له في المجلس بغير أمر الواهب جاز، وإن قبض بعد الافتراق لم تصح، إلا أن يأذن له الواهب في القبض.

الْهِبَةُ فِي اللُّغَةِ هِيَ التَّبَرُّعُ وَفِي الشَّرْعِ عِبَارَةٌ عَنْ تَمْلِيكِ الْأَعْيَانِ بِغَيْرِ عِوَضٍ وَهِيَ جَائِزَةٌ بِالْكِتَابِ وَهُوَ قَوْله تَعَالَى {فَإِنْ طِبْنَ لَكُمْ عَنْ شَيْءٍ مِنْهُ نَفْسًا فَكُلُوهُ هَنِيئًا مَرِيئًا} [النساء: 4] أَيْ هَنِيئًا لَا إثْمَ فِيهِ

مَرِيئًا لَا مَلَامَةَ فِيهِ وَقِيلَ الْهَنِيءُ الطَّيِّبُ الْمَسَاغِ الَّذِي لَا يُنَغِّصُهُ شَيْءٌ وَالْمَرِيءُ الْمَحْمُودُ الْعَاقِبَةِ الَّذِي لَا يَضُرُّ وَلَا يُؤْذِي وَبِالسُّنَّةِ وَهُوَ قَوْلُهُ - عَلَيْهِ السَّلَامُ - «تَهَادَوْا تَحَابُّوا 

 

الدر المختار وحاشية ابن عابدين (رد المحتار) (5/ 687)

لمناسبة ظاهر (هي) لغة: التفضل على الغير ولو غير مال. وشرعا: (تمليك العين مجانا) أي بلا عوض لا أن عدم العوض شرط فيه

وأما تمليك الدين من غير من عليه الدين فإن أمره بقبضه صحت لرجوعها إلى هبة العين

 ألا ترى أن الهبة تتم بها (وسببها إرادة الخير للواهب) دنيوي كعوض ومحبة وحسن ثناء، وأخروي: قال الإمام أبو منصور يجب على المؤمن أن يعلم ولده الجود والإحسان
