Title

Sexual relations with my step mother

Question

Asalamoalaykum,

I was reading Fiqh fatwa 16499 about haramat musahara, something I just now learned about, and saw the explanation of Mawlana Zafar regarding a son and step-mother touching with lust and thereby the marriage is broken between the step-mother and father (her husband).  Unfortunately, I have fallen into this situation.  My step-mother and I had sexual relations one day after she and my father had a big fight.  We both have made tauba for it already and honestly regret that it happened.  She and my father already have a child together and now she is pregnant with my child.  I hate being in this situation and really wished it never happened.  But since it has, I need to know the following and I have no one else to ask.

  1. Is the marriage between my father and my step-mother still valid?
  2. Next steps for their existing child?
  3. And next steps for our upcoming child?
  4. If they get divorced, is it allowed for her and me to get married since we are now having a child together?

Answer

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

1.      You state that you had sexual relations with your step mother. Therefore, her marriage with your father has terminated the moment you touched her with lust.[1] Your step mother became haram upon your father forever.

2.      It is unfortunate that the existing child is also going to suffer the effect of your immoral act due to the termination of the parent’s marriage.

3.      Your upcoming child will not have a father according to sharia’h and his lineage will be attributed to his mother. He will neither inherit from you nor continue your lineage.[2]

4.      She was your father’s wife. Hence, she is haram on you forever.[3]

5.      We advise you to make tawbah and istighfaar and beg Allah to forgive you.

وظاهر أن حرمة المصاهرة عبارة عن حرمة الموطوءة على أصول الزاني وفروعه نسباً ورضاعاً وحرمة أصولها وفروعها على الزاني كذلك قال في (البحر): ولو قال: يوجب المحرمية لكان أولى لما في (الخانية): زنا بامرأة كان محرماً لابنتها لأنه حرم عليه نكاحها على التأبيد وهذا دليل على أن المحرمية تثبت بالوطء الحرام وبما يوجب حرمة المصاهرة انتهى.

المحيط البرهاني في الفقه النعماني (3/ 63)

قال محمد رحمه الله في «الأصل» : إذا وطىء الرجل امرأة بنكاح أو ملك أو فجور حرمت عليه أمُّها وابنتها، وهو محرم لهما؛ لأنه لا يجوز له نكاحهما، وحرمت هي على آبائه وأبنائه، وكما ثبتت هذه الحرمة بالوطء تثبت بالمسّ والتقبيل والنظر إلى الفرج بشهوة سواء كان بنكاح أو ملك أو فجور عندنا إذا كان المحل مشتهاه، ولا تثبت هذه الحرمة بالنظر إلى سائر الأعضاء وإن كان عن شهوة وحد، والشهوة: أن تنتشر آلته إليه بالنظر إلى الفرج أو المس إذا لم يكن منتشراً قبل هذا، وإذا كان منتشراً فإن كان يزداد قوة

قال: (والزنا يوجب حرمة المصاهرة) ، فمن زنى بامرأة أو وطئها بشبهة حرمت عليه أصولها وفروعها، وتحرم الموطوءة على أصول الواطئ وفروعه
