Title

Why is it obligatory to pray qadha umri?

Question

Assalam alaykum. My question is why is it obligatory to pray qadha umri if someone had missed salah since a long time? Many scholars say that salah which are missed intentionally by the person does not have qadha stating that the person missed it by neglecting intentionally and not due to a valid shariah excuse. So they say repentance to Allah(SAW)will be enough. And we all know Allah is most forgiving and most merciful to those who repent then why should someone make up missed prayer instead of asking repentance directly to Allah (SAW)? It's important your reply will be appreciated.

Answer

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

According to your understanding, if one misses out salah intentionally, then he should only make tawba as Allah is Most Forgiving. There is no need to make Qadhaa Umri. This understanding is incorrect for the following reasons.

1) If one missed salaah unintentionally for example due to sleep, then he has to make qadha. See the following hadeeth,

عَنْ أَنَسِ بْنِ مَالِكٍ، قَالَ قَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم ‏ “‏ إِذَا رَقَدَ أَحَدُكُمْ عَنِ الصَّلاَةِ أَوْ غَفَلَ عَنْهَا فَلْيُصَلِّهَا إِذَا ذَكَرَهَا فَإِنَّ اللَّهَ يَقُولُ أَقِمِ الصَّلاَةَ لِذِكْرِي ‏”‏

Translation: Narrated by Anas bin Malik (Radhi Allahu anhu) that the Rasulullah (Sallallaho Alaihe Wassallam) said: When any one of you omits the prayer due to sleep or he forgets it, he should observe it when he remembers it, for Allah has said:” Observe prayer for remembrance of Me.” [Muslim] [i]

 

There is no sin in an unintentional act where as to leave out salah intentionally is sinful.

When one has to make qadhaa for a salah that was missed out unintentionally which is not sinful, then it is more logical that one has to make qadhaa of a salah that was deliberately missed out.

 

2) The tawba for a missed salah is to make qadhaa of the salah. Tawba is not confined to more verbal utterance of tawba. If we regard tawba only as a verbal tawba on the grounds that Allah is Most Forgiving, then the same rule will apply for a person who deliberately missed out fast in Ramadan. In that situation Allah states that the person will have to give penalty of fasting sixty days and one qadha fast despite Allah being Most Forgiving.

By the same analogy, if one did not pay zakaat, he simply has to make tawba and not pay the zakat due on him.

It is clear that your understanding is incorrect. Qadha Umri is fardh and one has to perform it. Making qadhaa for missed salah is the tawba for missing salah. [ii] [iii]

أما الثاني فهو لزوم قضاء الفائتة فالأصل فيه أن كل صلاة فاتت عن الوقت بعد ثبوت    وجوبها  فيه فإنه يلزم قضاؤها سواء تركها عمدا أو سهوا أو بسبب نوم وسواء كانت الفوائت كثيرة أو قليلة
