Question Related To Hajj

Last Year My Dad Got Expired

The Total Responsibility Of Business Nd Home  Has Come on Me... Alhamdulliah M Not Afraid Of it Bcz Allah Swt Is There...

 

I have two Small Bro (17Yrs)

Hajj Is Farz on Me...I No That 

 

But as a big Brother M Having Total Responsibility On Me...

I Can't Leave The Responsibility Nd Perform...

Mom Is Saying That You And Your  Wife Plan For Hajj..But BROTHER Are Small Still Studying Nd M Having Responsibility ...

 

M Very Much Confused Now... I Need Help ..

Answer

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

In principle, if a free, sane Muslim male has enough funds to perform Hajj over and above the expenses of to fulfil his family’s needs[1], then Hajj becomes compulsory immediately.[2] You should perform Hajj at the first opportunity. Consider the following hadith:

عَنْ عَلِيٍّ، قَالَ قَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم ‏"‏ مَنْ مَلَكَ زَادًا وَرَاحِلَةً تُبَلِّغُهُ إِلَى بَيْتِ اللَّهِ وَلَمْ يَحُجَّ فَلاَ عَلَيْهِ أَنْ يَمُوتَ يَهُودِيًّا أَوْ نَصْرَانِيًّا وَذَلِكَ أَنَّ اللَّهَ يَقُولُ فِي كِتَابِهِ ‏:‏ ‏وَلِلَّهِ عَلَى النَّاسِ حِجُّ الْبَيْتِ مَنِ اسْتَطَاعَ إِلَيْهِ سَبِيلاً‏ ‏"‏ [3]

 

Ali narrated that:

The Messenger of Allah said: "Whoever has the provisions and the means to convey him to Allah's House and he does not perform Hajj, then it does not matter if he dies as a Jew or a Christian. That is because Allah said in His Book: 'And Hajj to the House is a duty that mankind owes to Allah, for whomever is able to bear the journey.'

 

An alternative for the business would be appointing someone you trust as a manager to run the business in your absence.

( ومنها القدرة على الزاد والراحلة ) بطريق الملك أو الإجارة دون الإعارة والإباحة سواء كانت الإباحة من جهة من لا منة له عليه كالوالدين والمولودين أو من غيرهم كالأجانب كذا في السراج الوهاج ، ولو وهب له مال ليحج به لا يجب عليه قبوله سواء كان الواهب ممن تعتبر منته كالأجانب أو لا تعتبر كالأبوين والمولودين كذا في فتح القدير وتفسير ملك الزاد والراحلة أن يكون له مال فاضل عن حاجته ، وهو ما سوى مسكنه ولبسه وخدمه ، وأثاث بيته قدر ما يبلغه إلى مكة ذاهبا وجائيا راكبا لا ماشيا وسوى ما يقضي به ديونه ويمسك لنفقة عياله ، ومرمة مسكنه ونحوه إلى وقت انصرافه كذا في محيط السرخسي ويعتبر في نفقته ونفقة عياله الوسط من غير تبذير ، ولا تقتير كذا في التبيين والعيال من تلزمه نفقته كذا في البحر الرائق ولا يترك نفقة لما بعد إيابه في ظاهر الرواية كذا في التبيين .

درر الحكام شرح غرر الأحكام (3/ 29)

( مُسْلِمٍ مُكَلَّفٍ صَحِيحٍ بَصِيرٍ لَهُ زَادٌ وَرَاحِلَةٌ فَضْلًا ) أَيْ زَائِدًا ( عَمَّا لَا بُدَّ مِنْهُ ) كَالسُّكْنَى وَالْخَادِمِ وَأَثَاثِ الْبَيْتِ وَالثِّيَابِ وَنَحْوِ ذَلِكَ ( وَعَنْ نَفَقَةِ عِيَالِهِ إلَى عَوْدِهِ مَعَ أَمْنِ الطَّرِيقِ ) ؛ لِأَنَّ الِاسْتِطَاعَةَ لَا تَثْبُتُ دُونَهُ

269 - فَرضِيَّة الْحَج هُوَ فرض على الْفَوْر مرّة فِي الْعُمر على كل مُكَلّف حر صَحِيح بَصِير قَادر على زَاد وراحلة ذَهَابه ورجوعه فَاضلا عَمَّا لابد مِنْهُ لِعِيَالِهِ إِلَى وَقت رُجُوعه بِشَرْط أَمن الطَّرِيق

الاختيار لتعليل المختار (1/ 140)

قال: (على كل مسلم حر عاقل بالغ صحيح قادر على الزاد والراحلة، ونفقة ذهابه وإيابه فاضلا عن حوائجه الأصلية، ونفقة عياله إلى حين يعود، ويكون الطريق أمنا)

قال - رحمه الله - (فرض مرة على الفور بشرط حرية وبلوغ وعقل وصحة وقدرة زاد وراحلة فضلت عن مسكنه وعما لا بد منه ونفقة ذهابه وإيابه وعياله)

وهو فرض على الفور وهو الأصح فلا يباح له التأخير بعد الإمكان إلى العام الثاني
