Is it permissible to rent out jewelry made of gold?


Assalamualaikum mufti sb


Can we rent gold?

 Can I rent jewellery made of gold for an amount in local currency for an agreed period of time?

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

It is permissible to rent or hire out one’s jewellery for a stipulated period. The specific amount will be due whether one utilizes the jewelry or not.  [i]

قَالَ واجارة الْحلِيّ جَائِزَة للرِّجَال كَانَت اَوْ النِّسَاء اذا اسْتَأْجرهَا فِي مُدَّة مَعْلُومَة بِأَجْر مَعْلُوم فاذا مَضَت الْمدَّة لزمَه الاجر سَوَاء استعملها اَوْ لم يستعملها

وان هَلَكت فَلَا ضَمَان فِيهَا الا ان يستعملها خلاف مَا يستعملها النَّاس

المبسوط للسرخسي (14/ 47)

قَالَ: - رَحِمَهُ اللَّهُ - وَإِنْ اسْتَأْجَرَ أَجِيرًا بِذَهَبٍ، أَوْ فِضَّةٍ يَعْمَلُ لَهُ فِي فِضَّةٍ مَعْلُومَةٍ يَصُوغُهَا صِيَاغَةً مَعْلُومَةً، فَهُوَ جَائِزٌ، وَكَذَلِكَ الْحُلِيُّ، وَالْآنِيَةُ، وَحِلْيَةُ السَّيْفِ وَالْمَنَاطِقُ وَغَيْرُهَا؛ لِأَنَّهُ اسْتَأْجَرَهُ لِعَمَلٍ مَعْلُومٍ بِبَدَلٍ مَعْلُومٍ، فَلَا تُشْتَرَطُ الْمُسَاوَاةُ بَيْنَ الْأُجْرَةِ
