Title: Can a husband take his wife back after issuing one divorce?

Question

Aslm. I need some clarity regarding a matter. A woman was given one talaq . Durine her iddat period she had committed zina with another man also during this period her ex husband comes in contact with her. She leaves the man she committed zina with and wants to get back with her ex husband. Does she need to make nikah again to get back with her ex husband if it is still within the iddat period? 

Answer

In the Name of Allah, the Most Gracious, The Most Merciful.

As-salaamu `alaykum wa-ramatullahi wa-barakatuh.

There are two types of talaq.

  1. Revocable divorce (talaq raj`ee). In this type of talaq, the husband issues his wife talaq in clear words, for example, I divorce you. When the wife is in iddat of this type of talaq, the husband can revoke the divorce by stating to her, I take you back as a wife or by being intimate with her. There is no need to have a new nikah if they wish to reconcile within the iddat period and the husband did not issue her 2 divorces before this.[1]
  2. Irrevocable divorce (talaq ba`in). In this type of talaq the husband issues his wife talaq in ambiguous words, for example, the husband tells his wife, go to your parent’s house. If they wish to reconcile and get back together, they have to have a new nikaah. [2]

وبلغنا عنه فى هذه الآية: {الطلاق مرتان فإمساك بمعروف أو تسريح بإحسان} (6)، يقول: إن شاء راجعها قبل انقضاء العدة، وإن شاء تركها حتى تنقضي العدة من بعد الثالثة (7) وهي في العدة، فلا تحل له حتى تنكح زوجا غيره

 

شرح مختصر الطحاوي للجصاص (5/ 20)

قال أبو جعفر: (وإذا طلقها بأن قال لها: أنت طالق، أو: قد طلقتك: فإنه يملك رجعتها، فإن شاء راجعها قبل انقضاء العدة، وإن شاء تركها حتى تنقضي عدتها".

المبسوط للسرخسي (6/ 19)

وإذا أراد أن يراجعها قبل انقضاء العدة فأحسن ذلك أن لا يغشاها حتى يشهد شاهدين على رجعتها والإشهاد على الرجعة مستحب عندنا،

 

التجريد للقدوري (10/ 4998)

وهذه المسألة مبينة عندنا على أن الطلاق الرجعي لا يحرم الوطء، وإنما الوطء رجعة، ووطء الزوجة لا يوجب المهر، ولأنه يصير مراجعًا بالجزء الأول من اللمس، فيحصل الوطء، ولا عدة، فيوجب المهر.

شرح مختصر الطحاوي للجصاص (5/ 56)

قال أبو جعفر: (ومن قال لزوجته: أنت خلية، أو: برية، أو: بائن، أو: بتة، أو: حرام، أو: اعتدي، أو: أمرك بيدك، أو: اختاري، فقالت قد اخترت نفسي، فقال الزوج: لم أرد بذلك طلاقًا، فإن كان في ذكر طلاق: لم يقبل قوله، وكان ذلك طلاقًا بائنًا، غير اعتدي: فإنه رجعي".

فَإِنْ كَانَا حُرَّيْنِ فَالْحُكْمُ الْأَصْلِيُّ لِمَا دُونَ الثَّلَاثِ مِنْ الْوَاحِدَةِ الْبَائِنَةِ، وَالثِّنْتَيْنِ الْبَائِنَتَيْنِ هُوَ نُقْصَانُ عَدَدِ الطَّلَاقِ، وَزَوَالُ الْمِلْكِ أَيْضًا حَتَّى لَا يَحِلَّ لَهُ وَطْؤُهَا إلَّا بِنِكَاحٍ جَدِيدٍ وَلَا يَصِحُّ ظِهَارُهُ، وَإِيلَاؤُهُ وَلَا يَجْرِي اللِّعَانُ بَيْنَهُمَا وَلَا يَجْرِي التَّوَارُثُ وَلَا يُحَرَّمُ حُرْمَةً غَلِيظَةً حَتَّى يَجُوزَ لَهُ نِكَاحُهَا مِنْ غَيْرِ أَنْ تَتَزَوَّجَ بِزَوْجٍ آخَرَ؛ لِأَنَّ مَا دُونَ الثَّلَاثَةِ - وَإِنْ كَانَ بَائِنًا - فَإِنَّهُ يُوجِبُ زَوَالَ الْمِلْكِ لَا زَوَالَ حِلِّ الْمَحَلِّيَّةِ.
