Title: Job Involving Taxes

Question

Assalamu Alykum Shaikh 

 

I am transitioned between jobs and have given an interview at a place where my job roles would include helping them to expand their operations and entering into new geographical territories and would involve dealing with government and development authorities for getting licenses etc.

 

My question is that as I know that taxes, where income or VAT and customs tax (upon the importation of products into the country) comes under the heading of mukoos or jizyah which is Haram as I know. Please correct me if I am wrong.

 

Therefore I would like to know whether taking my role and income derived from it and dealing with the agencies to set up the business and registering with the authorities to pay the above mentioned dues would be halal or not as that would be the majority of my role along with other tasks.

 

I would like to know the answer based on your knowledge and Shariah.

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

In order for us to advise you, explain what exactly your role would be. According to our understanding, you would be setting up businesses and registering them with the authorities. That is where your role ends. If so, your income is permissible.

You are not responsible for the government charges and the various taxes. That is apart from the fact that not all taxes fall under mukoos.[1]

الموافقات (٣/٦٣)

وَفِي مُسْلِمٍ عَنْ أَبِي سَعِيدٍ، [قَالَ] : بَيْنَمَا نَحْنُ فِي سَفَرٍ مَعَ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ؛ إِذْ جَاءَ رَجُلٌ عَلَى رَاحِلَةٍ لَهُ -قَالَ- فَجَعَلَ يَصْرِفُ بَصَرَهُ يَمِينًا وَشَمَالًا. فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: "مَنْ كَانَ مَعَهُ فَضْلُ ظَهْرٍ؛ فَلْيَعُدْ بِهِ عَلَى مَنْ لَا ظَهْرَ لَهُ، وَمَنْ كَانَ مَعَهُ فَضْلٌ مِنْ زَادٍ؛ فَلْيَعُدْ بِهِ عَلَى مَنْ لَا زَادَ لَهُ". قَالَ: فَذَكَرَ مِنْ أَصْنَافِ الْمَالِ مَا ذَكَرَ؛ حَتَّى رَأَيْنَا أَنَّهُ لَا حَقَّ لأحد منا في فضل٣.
