Title: Can the client claim his money back?

Question

السلام عليكم ورحمة الله وبركاته

Mufti Saheb A travel agent in July offered available accommodation for one week in August to a client at R35000. The client agreed to purchase, confirmed and paid for it.

The agent then purchased and paid another agent R30000 who paid the hotel R25000 confirmed and reserved the booking. The hotel sent the confirmation letter and a guest certificate with the clients name and particulars.

Now in September the client tells the agent that he never check in to the hotel because he stayed elsewhere so he wants his R35000 back.

Can the client claim his money back? The agent inbetween as well as the hotel refuses to refund the agent because the duration of the stay is over. What does the agent do now?

If the client had full access and right to stay in the hotel room but on his free will, he decided to stay elsewhere, then the travel agent will not be held liable for any refund. [1]

وقد تقدم أنه إذا كانت الإجارة صحيحة وتمكن من الانتفاع يجب الأجر
