Title: Can I get paid for taking care of my mother?

Question

Assalamualaikum,

I wanted to know if it is permissible to work as a government-sponsored personal care aide for y own mother. Let me explain. My mother is elderly and I do almost all the work for her, such as cook for her, bathe her, feed her, clean up after her, take her out to walk, to the doctor, etc. I have been doing this for many years ago. Recently, I found out that she is eligible for government-sponsored care, and a program where you get paid to Take Care of a Family Member. I recently enrolled in this and they gave me hours, and a schedule for which I get "paid" to take care of my mother. Now, the actual hours I spend taking care of her are obviously not limited to those hours because I have to look after her 24/7, and I am more than happy to do this as I'm her daughter. I just feel guilty that I enrolled in the program and am getting "paid" to take care of my own mother. As she is my mother, I have a responsibility to care for her, by taking payment from the government because she is elderly and eligible for the program, is this a halal income for me? Again, the hours I spend caring for her is 24/7 but the program allows for 20 paid hours/week. I really need to know if this is halal for me to take.

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

You are nursing your mother as a daughter and not as an employee. The government is actually assisting you in your service to your mother so that you may not be so concerned about earning your livelihood. The assistance rendered to you by the government for serving your mother is halal. This does not invalidate your sincerity in serving your mother. You will still get the reward of serving your mother, especially considering the fact that you do not confine your service to the 20 hours stipulated.[1][2]

أما إن كان محتاجا إلى الصدقة، وممن يستحقونها لفقر أو زمانة، أو عجز عن الكسب فيجوز له السؤال بقدر الحاجة، وبشرط أن لا يذل نفسه، وأن لا يلح في السؤال، أو يؤذي المسئول، ولم يعلم أن باعث المعطي الحياء من السائل أو من الحاضرين، فإن كان شيء من ذلك فلا يجوز له السؤال وأخذ الصدقة وإن كان محتاجا إليها، ويحرم أخذها

وإن استأجر الرجل ابنه ليخدمه في بيته لم يجز ولا أجر عليه؛ لأن خدمة الأب مستحق على الابن دينا وهو مطالب به عرفا فلا يأخذ عليه أجرا ويعد من العقوق أن يأخذ الولد الأجر على خدمة أبيه والعقوق حرام، وكذلك إن استأجرته الأم؛ لأن خدمتها أوجب عليه فإنها أحوج إلى ذلك وأشفق عليه، وإن كان أحدهما استأجره ليرعيه غنما، أو يعمل غير الخدمة جاز فإن ذلك غير مستحق عليه ولا هو مطلوب في العرف

ولو استأجر الرجل ابنه او عبد رجل جازت الاجارة فان خدمه وجب الأجر

 

فتح القدير للكمال ابن الهمام (6/ 137)

والأب إذا استأجر ابنه ليخدمه لا يستحق عليه أجرة لأن خدمته واجبة على الابن فوجب من وجه وانتفى من وجه فلا يجب بالشك، وهذا يفيد عدم الوجوب؛ وإن لم يكن في عياله، فإذا كان في عياله فبطريق الأولى
