Title: Zakaat on borrowed money

Question

Assalamu alaykum 

Do I pay zakaat on money that I have lent someone ? I know they will pay me back but it may be in many many years . It is a large sum and I dont want the zakaat to accumulate .

Answer

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh. 

Zakaat is wajib on debts owed to one[1]. Zakaat has to be paid on money you lent someone. You may pay the Zakaat every year or after being paid.

The procedure of calculating Zakat is to pay 2.5% in the first year. The second year you must pay 2.5% on the balance after deducting 2.5% of the first year and so forth.

وَأَمَّا حَوَلَانُ الْحَوْلِ فَلَيْسَ مِنْ شَرَائِطِ جَوَازِ أَدَاءِ الزَّكَاةِ عِنْدَ عَامَّةِ الْعُلَمَاءِ. بدائع الصنائع في ترتيب الشرائع (4/ 46)

 

سَبَبِ الْوُجُوبِ وَهُوَ مِلْكُ نِصَابٍ كَامِلٍ نَامٍ أَوْ فَاضِلٍ عَنْ الْحَاجَةِ الْأَصْلِيَّةِ لِحُصُولِ الْغِنَى بِهِ وَلِوُجُوبِ شُكْرِ نِعْمَةِ الْمَالِ عَلَى مَا بَيَّنَّا فِيمَا تَقَدَّمَ . بدائع الصنائع في ترتيب الشرائع (4/ 46)

 

وَالْأَصْلُ فِيهِ حَدِيثُ عَلِيٍّ «لَا زَكَاةَ فِي مَالِ الضِّمَارِ» وَهُوَ مَا لَا يُمْكِنُ الِانْتِفَاعُ بِهِ مَعَ بَقَاءِ الْمِلْكِ.

 (قَوْلُهُ لَا زَكَاةَ فِي مَالِ الضِّمَارِ) الضِّمَارُ بِالضَّادِ الْمُعْجَمَةِ بِوَزْنِ حِمَارٍ. قَالَ فِي الْبَحْرِ: وَهُوَ فِي اللُّغَةِ الْغَائِبُ الَّذِي لَا يُرْجَى، فَإِذَا رُجِيَ لَيْسَ بِضِمَارٍ، وَأَصْلُهُ الْإِضْمَارُ، وَهُوَ التَّغْيِيبُ وَالْإِخْفَاءُ، وَمِنْهُ أَضْمَرَ فِي قَلْبِهِ شَيْئًا. الدر المختار وحاشية ابن عابدين (رد المحتار) (2/ 266)

 (وَ) اعْلَمْ أَنَّ الدُّيُونَ عِنْدَ الْإِمَامِ ثَلَاثَةٌ: قَوِيٌّ، وَمُتَوَسِّطٌ، وَضَعِيفٌ؛ (فَتَجِبُ) زَكَاتُهَا إذَا تَمَّ نِصَابًا وَحَالَ الْحَوْلُ، لَكِنْ لَا فَوْرًا بَلْ (عِنْدَ قَبْضِ أَرْبَعِينَ دِرْهَمًا مِنْ الدَّيْنِ) الْقَوِيِّ كَقَرْضٍ (وَبَدَلِ مَالِ تِجَارَةٍ) فَكُلَّمَا قَبَضَ أَرْبَعِينَ دِرْهَمًا يَلْزَمُهُ دِرْهَمٌ. الدر المختار وحاشية ابن عابدين (رد المحتار) (2/ 305)
