Title: Making up the missed prayers

Question

Salam.

When making up a lot of Qadha Salaah (e.g. 20 Fajr Salaah, 10 Zuhr Salaah, 5 Asr Salaah, 5 Magrib Salaah and 10 Isha Salaah and 10 Witr Salaah), what order does one have to pray them in?

Is it possible to make up all the Fajr Salaah first, then all the Zuhr Salaah etc or should the Salaah be performed by first making up one Fajr Salaah, then one Zuhr Salaah, then one Asr Salaah etc until all the Salaah are completed.

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

Dear Brother,

Allah Taa’la says in the Quran:

ان الصلوة كانت على المؤمنين كتابا موقوتا

Translation: Indeed, prayer has been decreed upon the believers a decree of specified times. Surah An-Nisaa 103

Rasulullah Sallallahu Alihi wasallam said:

الصلاة عماد الدين

Translation: “Salah is foundation of the religion (Islam)”. Shu’abul Iman Bayhaqi (3/39)

 

A Muslim ought to be sensitive in performing Salah on time. He should not miss out a single Salah.  

اول ما يحاسب به العبد يوم القيامة صلاته

Translation: The first thing for which the Muslim will be brought to account on the Day of Resurrection will be the prescribed (Fardh) prayers”. Musnad Ahmad (27/160)

If one has missed out any Salah, he should make qadha (make up) of the missed Salah as soon as possible. He should perform the missed Salah before performing the Salah that is due for that time.

If one misses more than one Salah, he should perform the missed Salah in sequence and order. For example, if one missed Zuhr and Asr Salah, he should first perform Zuhr Salah, then the Asr Salah before the Maghrib Salah.

However, if one misses more than five Salah, he does not have to maintain sequence and order in fulfilling the missed Salah, he may perform the missed Salah in any sequence.  Therefore, if one has missed numerous fajr salah or numerous zuhr salah, he may do qadha of all the fajr salah at once or he can make it up before the fajr salah of that day and before the zuhr salah of that day etc.

وَعَلَى هَذَا صَاحِبُ التَّرْتِيبِ إذَا تَذَكَّرَ فَائِتَةً؛ لِأَنَّهُ ظَهَرَ أَنَّهُ أَدَّى الْوَقْتِيَّةَ قَبْلَ وَقْتِهَا فَكَانَ يَنْبَغِي أَنْ يَجِبَ قَضَاءُ الْكُلِّ إلَّا أَنَّهُ سَقَطَ لِلْحَرَجِ؛ لِأَنَّ النِّسْيَانَ مِمَّا يَكْثُرُ وُجُودُهُ، وَلَا حَرَجَ فِي حَقِّ هَذِهِ الصَّلَاةِ.

التَّرْتِيب فِي أَدَاء الصَّلَوَات المكتوبات فرض بِلَا خلاف...... ثمَّ التَّرْتِيب لَا يجب عِنْد النسْيَان وَلَا عِنْد ضيق الْوَقْت وَعند كَثْرَة الْفَوَائِت فِي قَول عَامَّة الْعلمَاء.

ثُمَّ التَّرْتِيبُ فِي أَدَاءِ الصَّلَوَاتِ فِي أَوْقَاتِهَا لِضَرُورَةِ التَّرْتِيبِ فِي أَوْقَاتِهَا وَذَلِكَ لَا يُوجَدُ فِي الْفَوَائِتِ؛ لِأَنَّهَا صَارَتْ مُرْسَلَةً عَنْ الْوَقْتِ ثَابِتَةً فِي الذِّمَّةِ فَكَانَ قِيَاسُ قَضَاءِ الصَّوْمِ مَعَ الْأَدَاءِ.

وَأَمَّا إنْ كَثُرَتْ الْفَوَائِتُ فَاخْتَلَفُوا فِي اشْتِرَاطِ التَّعْيِينِ لِتَمْيِيزِ الْفُرُوضِ الْمُتَّحِدَةِ مِنْ جِنْسٍ وَاحِدٍ وَالْأَصَحُّ أَنَّهُ إنْ كَانَ عَلَيْهِ قَضَاءُ يَوْمٍ مِنْ رَمَضَانَ وَاحِدٍ فَصَامَ يَوْمًا نَاوِيًا عَنْهُ وَلَكِنْ لَمْ يُعَيِّنْ أَنَّهُ عَنْ يَوْمِ كَذَا فَإِنَّهُ يَجُوزُ، وَلَا يَجُوزُ فِي رَمَضَانَيْنِ مَا لَمْ يُعَيِّنْ أَنَّهُ صَائِمٌ عَنْ رَمَضَانَ سَنَةَ كَذَا وَأَمَّا قَضَاءُ الصَّلَاةِ فَلَا يَجُوزُ مَا لَمْ يُعَيِّنْ الصَّلَاةَ وَيَوْمَهَا بِأَنْ يُعَيِّنَ ظُهْرَ يَوْمِ كَذَا وَلَوْ نَوَى أَوَّلَ ظُهْرٍ عَلَيْهِ أَوْ آخِرَ ظُهْرٍ عَلَيْهِ جَازَ وَهَذَا هُوَ الْمَخْلَصُ لِمَنْ لَمْ يَعْرِفْ الْأَوْقَاتَ الْفَائِتَةَ أَوْ اشْتَبَهَتْ عَلَيْهِ أَوْ أَرَادَ التَّسْهِيلَ عَلَى نَفْسِهِ وَذُكِرَ فِي الْمُحِيطِ أَنَّ نِيَّةَ التَّعْيِينِ فِي الصَّلَاةِ لَمْ تُشْتَرَطْ بِاعْتِبَارِ أَنَّ الْوَاجِبَ مُخْتَلِفٌ مُتَعَدِّدٌ بَلْ بِاعْتِبَارِ أَنَّ مُرَاعَاةَ التَّرْتِيبِ وَاجِبٌ عَلَيْهِ وَلَا يُمْكِنُهُ مُرَاعَاةُ التَّرْتِيبِ إلَّا بِنِيَّةِ التَّعْيِينِ حَتَّى لَوْ سَقَطَ التَّرْتِيبُ بِكَثْرَةِ الْفَوَائِتِ تَكْفِيهِ نِيَّةُ الظُّهْرِ لَا غَيْرُ.

وأما بيان وقت أدائها فما وجب أداؤها خارج الصلاة فوقتها جميع العمر؛ لأن وجوبها على التراخي على ما مر.
