Title: Did i give divorce to my wife or not?

Question

السلام عليكم ورحمةالله وبركاته......if I had no intention of divorcing my wife but just to get her to come to her senses and stop her bad ways I said over the phone "I give u divorce " but before I said it, I made a verbal intention with Allah saying "ya Allah I dont intend to divorce my wife at all and I dont mean this at all, I'm just trying to make her come to realization of how serious I am about my Deen " then I say those words, will it still be checked as a divorce? 

Answer

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

At the outset, one should realize that the issue of talaq is critical. It is narrated by Hazrat Abu Hurairah Radhiyallahu Anhu that Rasulullah Sallallahu Alayhi Wasallam said: There are three things, in seriousness they are treated as serious and in joking they are treated as serious: Marriage, divorce and taking back a wife after a revocable talaq[1].

If one utters the words of talaq while attributing it to his wife, the talaq will be valid[2].

In the enquired situation one talaq raji’e [revocable talaq] took place[3]. Your intention:"ya Allah I don’t intend to divorce my wife at all and I don’t mean this at all, I'm just trying to make her come to realization of how serious I am about my Deen” will not affect the validity of talaq[4]. You may reconcile with your wife within the Iddah period[5] without performing nikah. If the iddat has expired and you did not revoke the divorce within the iddat period, the nikah is terminated. You will have to perform a new nikah again.

You should understand the seriousness of this issue and should never issue her divorce in future under normal circumstances.

You may refer to Hadrath Mufti Shafi Sahib’s commentary on verse 34 of Surah Al-Nisa in Maariful Quran where he discusses the issue “How to correct an uncooperative wife”.

وإذا قال لها: أنت طالق، فقوله لها: أنت طالق، يقع بالكلمًة بعينها الطلاق سواء البتة لا يحتاج فيها إلى نية.

وقوله عليه الصلاة والسلام: "ثلاث جدهن جد وهزلهن جد": يدل على ذلك أيضًا؛ لأنه عليه الصلاة والسلام سوى بين الجاد والهازل، مع وجود الإرادة من أحدهما في إيقاع حكم اللفظ، وعدمها من الآخر، مع كونهما من أهل التكليف

مسألة: [الرجعة في الطلاق الرجعي]

قال: (ومن طلق امرأته طلاقًا رجعيًا: فله أن يراجعها في العدة، ويتوارثان ما بقيت العدة).

لقول الله تعالى: {وبعولتهن أحق بردهن في ذلك}، فأفادنا بذلك معنيين: أحدهما: أنه سماه بعلًا بعد الطلاق، وقال الله تعالى: {ولكم نصف ما ترك أزوجكم}.

والثاني: أنه جعله أحق بها في العدة.

وقال تعالى: {الطلاق مرتان فإمساك بمعروف}، فأجاز له الإمساك بعد الطلاق
