Title: Divorce Misconceptions


Assalamoalaikum, I asked this question no 1 on 26 March 2018 and then again on 22 April 2018 and still waiting for reply. I have posted my question again below. Kindly answer the questions below. now I have also added one more question (question no 2). 1. I was looking at tax return website for the reason of lodging tax return as it was required to be lodged by both parents for the assessment of family tax benefit.

We need to update our details I think every financial year. We have one child and we receive family tax benefit. My husband did lodge his tax return and asked me to lodge a non lodgement as i m not earning at this stage. It was all to update our tax information. When i went to tax website there was a statement which confused me was: "you need to lodge if you were a liable parent or a recipient parent under a child support assessment unless you receive government allowances etc" I couldn't understand the statement and asked my husband to explain he read this above statement aloud and tried to explain the meaning by saying that it says if you are a split parent and looking after a child (something like that) then you need to lodge tax return. (i don't remeber exact wording what he said). I just quickly asked him that you are telling me the meaning of this statement and he said Yes. Is the Nikkah valid? I just got scared cause he used words like if you are a split parent (but he was only explaining that statement to me and reading that statement aloud). After that I lodged my non lodgment of tax later as i am not earning at this stage and needed to notify tax office as well as updating my details for family tax benefit we are receiving for our child.

I asked my husband later that you meant tax return needs to b lodged by couples like us ( means married ) and other split couples too? He said yes he meant that and did not have any other bad intention. Is nikkah valid? 2. The other question is also regarding some past argument happened with my husband over something I do not remember. My husband either said “ if you want i can contact marriage counseling or counsellors” or he said “ I think we should contact marriage conselling” something like that. I do not remember what exactly he said but he talked about marriage counseling.

I roughly remember he explained that it was to resolve arguments and how to control fights etc and no other bad intention. When i asked again he said that Marriage counselling save marriages and there wasn’t any other bad intention ( regarding divorce) in his mind. Is Nikkah valid? JazakAllah khair

وَلَا خِلَافَ أَنَّهُ لَا يَقَعُ الطَّلَاقُ بِشَيْءٍ مِنْ أَلْفَاظِ الْكِنَايَةِ إلَّا بِالنِّيَّةِ فَإِنْ كَانَ قَدْ نَوَى الطَّلَاقَ يَقَعُ فِيمَا بَيْنَهُ وَبَيْنَ اللَّهِ تَعَالَى، وَإِنْ كَانَ لَمْ يَنْوِ لَا يَقَعُ فِيمَا بَيْنَهُ وَبَيْنَ اللَّهِ تَعَالَى، وَإِنْ ذَكَرَ شَيْئًا مِنْ ذَلِكَ ثُمَّ قَالَ: مَا أَرَدْتُ بِهِ الطَّلَاقَ يُدَيَّنُ فِيمَا بَيْنَهُ وَبَيْنَ اللَّهِ تَعَالَى؛ لِأَنَّ اللَّهَ تَعَالَى يَعْلَمُ سِرَّهُ وَنَجَوَاهُ

(وَلَا يَقَعُ بِهَا) أَيْ وَلِهَذَا لَا يَقَعُ الطَّلَاقُ بِالْكِنَايَاتِ قَضَاءً (إلَّا بِنِيَّةٍ) أَيْ بِنِيَّةِ الزَّوْجِ، أَوْ الطَّلَاقِ مُضَافًا إلَى الْفَاعِلِ، أَوْ الْمَفْعُولِ (أَوْ دَلَالَةِ حَالٍ) ؛ لِأَنَّهَا غَيْرُ مَوْضُوعَةٍ لِلطَّلَاقِ بَلْ مَوْضُوعَةٌ لِمَا هُوَ أَعَمُّ مِنْهُ وَالْمُرَادُ بِدَلَالَةِ الْحَالِ الْحَالَةُ الظَّاهِرَةُ الْمُفِيدَةُ لِمَقْصُودِهِ وَفِيهِ إشَارَةٌ إلَى أَنَّ الْكِنَايَاتِ غَيْرُ مُؤَثِّرَةٍ بِدُونِ النِّيَّةِ وَدَلَالَةِ الْحَالِ

وَإِذَا لَمْ يَكُنْ صَرِيحًا كَانَ كِنَايَةً لِعَدَمِ الْوَاسِطَةِ وَالْكِنَايَةُ تَحْتَاجُ إلَى النِّيَّةِ

 [أَلْفَاظٍ يَقَعُ بِهَا الطَّلَاقُ الرَّجْعِيُّ]

قَالَ (وَأَمَّا الضَّرْبُ الثَّانِي وَهُوَ الْكِنَايَاتُ) لَمَّا فَرَغَ مِنْ الضَّرْبِ الْأَوَّلِ وَهُوَ الصَّرِيحُ شَرَعَ فِي بَيَانِ الضَّرْبِ الثَّانِي وَهُوَ الْكِنَايَاتُ. الْكِنَايَةُ: مَا اسْتَتَرَ الْمُرَادُ بِهِ

وَحُكْمُهَا أَنَّهُ لَا يَجِبُ الْعَمَلُ بِهَا إلَّا بِالنِّيَّةِ أَوْ مَا يَقُومُ مَقَامَهَا مِنْ دَلَالَةِ الْحَالِ لِأَنَّهَا غَيْرُ مَوْضُوعَةٍ لِمَا اُسْتُعْمِلَتْ فِيهِ بَلْ تَحْتَمِلُهُ وَغَيْرَهُ فَلَا بُدَّ مِنْ التَّعْيِينِ أَوْ دَلَالَتِهِ
