Is zakat compulsory upon a person who is disabled and receives money from the government?


My question regards to zakat.  Is zakat compulsory on a Muslim who is disable and receives a fixed amount from the government? Please answer my question before Ramadan ends.


In the Name of Allāh, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

Zakat is compulsory upon an adult and sane person who possesses the amount of Nisaab (i.e. 612.35 grams of silver or 87.47 grams of gold or currency, wealth equivalent to that amount) for a complete lunar year; which is over and above his basic needs and free from debts.[1]

Therefore, if an adult sane person has in his possession wealth which is free from his basic needs and this amount exceeds the amount of Nisaab after deduction of liabilities, then it will be compulsory to pay zakat on that amount upon passing of a complete lunar year.[2]

Disability alone is not an exemption from zakat. If a disabled person receives money from the government and the money is over and above his basis needs and equivalent to or more than the Nisaab of zakat, he will have to give zakat on his savings.

( الزكاة واجبة على الحر العاقل البالغ المسلم إذا ملك نصابا ملكا تاما وحال عليه الحول ) أما الوجوب فلقوله تعالى { وآتوا الزكاة } ولقوله عليه الصلاة والسلام { أدوا زكاة أموالكم } وعليه إجماع الأمة ، والمراد بالواجب الفرض لأنه لا شبهة فيه ، واشتراط الحرية لأن كمال الملك بها ، والعقل والبلوغ لما نذكره ، والإسلام لأن الزكاة عبادة ولا تتحقق من الكافر ، ولا بد من ملك مقدار النصاب لأنه عليه الصلاة والسلام قدر السبب به ، ولا بد من الحول لأنه لا بد من مدة يتحقق فيها النماء ، وقدرها الشرع بالحول لقوله عليه الصلاة والسلام { لا زكاة في مال حتى يحول عليه الحول } ولأنه المتمكن به من الاستنماء لاشتماله على الفصول المختلفة ، والغالب تفاوت الأسعار فيها فأدير الحكم عليه .

ثم قيل : هي واجبة على الفور لأنه مقتضى مطلق الأمر ، وقيل على التراخي لأن جميع العمر وقت الأداء ، ولهذا لا تضمن بهلاك النصاب بعد التفريط .
