Do i have to give Zakaat on my childs wealth?


My small  daughter has got some gift as gold and cash. We are bit confused whether we need to give zakat for it. Would you please enlighten us by evaluating our case here. She has 39g of gold equivalent to 1404 USD  and cash as 586 USD. Do we nned to give zakat for it?


In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

In principle, there is no Zakaat due on a minor. Therefore, there is no Zakaat due on the gold and cash belonging to your daughter. [1]

كِتَابُ الزَّكَاةِ وَلَا تَجِبُ إِلَّا عَلَى الْحُرِّ الْمُسْلِمِ الْعَاقِلِ (ف) الْبَالِغِ (ف) إِذَا مَلَكَ نِصَابًا خَالِيًا عَنِ الدَّيْنِ فَاضِلًا عَنْ حَوَائِجِهِ الْأَصْلِيَّةِ مِلْكًا تَامًّا فِي طَرَفَيِ الْحَوْلِ


بدائع الصنائع في ترتيب الشرائع (2/ 4)

وَمِنْهَا الْبُلُوغُ عِنْدَنَا فَلَا تَجِبُ عَلَى الصَّبِيِّ وَهُوَ قَوْلُ عَلِيٍّ وَابْنُ عَبَّاسٍ فَإِنَّهُمَا قَالَا: " لَا تَجِبُ الزَّكَاةُ عَلَى الصَّبِيِّ حَتَّى تَجِبَ عَلَيْهِ الصَّلَاةُ

وَمِنْ أَصْحَابِنَا مَنْ بَنَى الْمَسْأَلَةَ عَلَى أَصْلٍ وَهُوَ أَنَّ الزَّكَاةَ عِبَادَةٌ عِنْدَنَا، وَالصَّبِيُّ لَيْسَ مِنْ أَهْلِ وُجُوبِ الْعِبَادَةِ فَلَا تَجِبُ عَلَيْهِ كَمَا لَا يَجِبُ عَلَيْهِ الصَّوْمُ وَالصَّلَاةُ،

(وَشَرْطُ وُجُوبِهَا الْعَقْلُ وَالْبُلُوغُ) إذْ لَا تَكْلِيفَ بِدُونِهِمَا (وَالْإِسْلَامُ) لِأَنَّهُ شَرْطٌ لِصِحَّةِ الْعِبَادَاتِ كُلِّهَا (وَالْحُرِّيَّةُ) لِيَتَحَقَّقَ التَّمْلِيكُ لِأَنَّ الرَّقِيقَ لَا يَمْلِكُ فَيُمْلَكُ

وإسلام وحرية وشرط افتراضها عقل وبلوغ

(قوله عقل وبلوغ) فلا تجب على مجنون وصبي لأنها عبادة محضة وليسا مخاطبين بها، وإيجاب النفقات والغرامات لكونها من حقوق العباد والعشر، وصدقة الفطر لأن فيهما معنى المؤنة
