Title: Will ‘I will divorce you very soon’ constitute divorce


ASALAM U ALAIKUM. I want to ask that if the husband threatens to divorce saying I'll divorce you very soon. Ask your parents to come and take you. Does that mean the divorce happened and I have to spend the idat period. I am waiting for your response since I don't want to commit any sin. JAZAK ALLAH.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

Sister in Islam,

The statement “I will divorce you very soon” is a will to divorce in future. It is not a confirmed divorce.[i] Therefore, your nikaah is intact.

While your husband’s threat of divorce to you is unfortunate, you too should avoid circumstances leading to such threats.

الدر المختار وحاشية ابن عابدين (رد المحتار)-فرفور (9/157) [i]

(قوله وما بمعناها من الصريح) أي مثل ما سيذكره من نحو: كوني طالقا واطلقي ويا مطلقة بالتشديد، وكذا المضارع إذا غلب في الحال مثل أطلقك كما في البحر. قلت: ومنه في عرف زماننا: تكوني طالقا، ومنه: خذي طلاقك فقالت أخذت، فقد صرح الوقوع به بلا اشتراط نية كما في الفتح، وكذا لا يشترط قولها أخذت كما في البحر

 لَوْ قَالَ بِالْعَرَبِيَّةِ أُطَلِّقُ لَا يَكُونُ طَلَاقًا إلَّا إذَا غَلَبَ اسْتِعْمَالُهُ لِلْحَالِ فَيَكُونُ طَلَاقًا وَفِي إيمَانِ مَجْمُوعِ النَّوَازِلِ سُئِلَ نَجْمُ الدِّينِ عَنْ امْرَأَةٍ قَالَتْ لِزَوْجِهَا مِنْ بِرّ تَوّ سَهِّ طَلَاقه أَمْ فَقَالَ الزَّوْجُ هَلَّا هَلْ تَطْلُقُ ثَلَاثًا قَالَ لَا إلَّا أَنْ يَنْوِيَهَا وَلَوْ قَالَتْ لِزَوْجِهَا حَلَال خَدًّا بِرّ توحرام فَقَالَ آرِيّ حُرِّمَتْ عَلَيْهِ بِتَطْلِيقَةٍ سُئِلَ نَجْمُ الدِّينِ عَنْ رَجُلٍ قَالَ لِامْرَأَتِهِ اذْهَبِي إلَى بَيْتِ أُمِّك فَقَالَتْ طَلَاق دَهٍ تابروم فَقَالَ تَوّ بَرْو مِنْ طَلَاقِ دُمَادِم فَرُسْتُمُ قَالَ لَا تَطْلُقُ لِأَنَّهُ وَعْدٌ كَذَا فِي الْخُلَاصَةِ


المحيط البرهاني في الفقه النعماني (3/ 472)

وبالعربية قوله: أطلق، لا يكون طلاقاً في أنه دائر بين الحال والاستقبال فلم يكن تحقيقاً مع الشك حتى أن موضع علمت استعماله للحال كان تحقيقاً
