Does the following joke equate to a talaaq?


I was talking with my wife in happy mode and she jokingly asked.

Am I not your wife? to which I jokingly replied. No. there was no anger / intention for anything. will this count as one tallaq (divorce)


In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.


This will not be considered as a talaaq[1]. However, avoid such jokes in future.

موضوعة له فلا يتعين إلا بالتعيين ، وهو أن ينوبه أو تدل عليه الحال فتترجح إرادته .

البحر الرائق شرح كنز الدقائق - (3 / 322)

( لَا تَطْلُقُ بها إلَّا بِنِيَّةٍ أو دَلَالَةِ الْحَالِ ) أَيْ لَا تَطْلُقُ بِالْكِنَايَاتِ قَضَاءً إلَّا بِإِحْدَى هَذَيْنِ لِأَنَّهَا غَيْرُ مَوْضُوعَةٍ لِلطَّلَاقِ بَلْ مَوْضُوعَةٌ لِمَا هو أَعَمُّ منه

 وَمِنْ حُكْمِهِ لِمَا سَيَأْتِي أَنْ ما عَدَا الثَّلَاثَ منها لم يَرِدْ بها الطَّلَاقُ أَصْلًا بَلْ ما هو حُكْمُهُ من الْبَيْنُونَةِ من النِّكَاحِ

 وَالْمُرَادُ بِدَلَالَةِ الْحَالِ الْحَالَةُ الظَّاهِرَةُ الْمُفِيدَةُ لِمَقْصُودِهِ وَمِنْهَا تَقَدُّمُ ذِكْرِ الطَّلَاقِ كما في الْمُحِيطِ لو قال لها أَنْت طَالِقٌ إنْ شِئْت وَاخْتَارِي فقالت شِئْت وَاخْتَرْت يَقَعُ طَلَاقَانِ أَحَدُهُمَا بِالْمَشِيئَةِ وَالْآخَرُ بِالِاخْتِيَارِ من غَيْرِ نِيَّةٍ لِتَقَدُّمِ الصَّرِيحِ عليها
