Title: What must be done with tax money which was refunded due to charity donations?

At this time of year Public Benefit organisations (PBO) are advertising for the application of Section 18A certificates to claim back on your tax return.

I would just like to enquire the following:

  • currently zakaat, sadaqah or lillah money is contributed to these organisations, eg. Al-imdaad, Gift of the givers, Crescent of hope, Madresah Nur & various other charities.
  • If one receives a Section 18A certificate for the above donations & money is received back again from SARS, what can this money be used for:
    • does the money have to be given back to charity?
    • can this money be used to pay traffic fines?
    • can this money be used for any other use?

Your trusted advice will be much appreciated.

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

The money you received from SARS will be considered a gift to you. [1] The money is halal even for personal use.

And Allah Ta’āla Knows Best
