Title: Can i be exempt from fasting due to epilepsy?

Question

As salamu alaykum,

I have been suffering from epilepsy for a majority of my life and i have medication to take in the mornings and evenings. I have fasted in the past alhamdulillah but recently i have unable to successfully comply to the obligations of fasting this blessed month due to my neurological condition and medication tablets that i need to take.

Sometimes when i delay in taking the tablets i notice getting tremors and dizzyness etc which increase fear in myself and due to the fear cause a fit to occur.

In such a helpless situation am i exempted from fasting ? Can i offer the required fidyah to compensate each day and will Allah forgive me as this is beyond my control and i so desire to fast ?

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

We make dua Allah grant you courage to overcome your health related challenges. Aameen.

In principle, if a person fears becoming sick due to fasting or he fears his sickness increasing then he will be excused from fasting. [1] He will have to make up his missed fast by keeping one qadha fast for each fast he missed. [2]

In your case, you have experienced that fasting aggravates your sickness.[3] Hence, you are exempted from fasting and you will have to pay fidyah for every missed fast. However, if you recover from your neurological condition to the extent that you are able to fast, then you will be required to make up all those fasts by fasting, including those for which you had already offered fidyah.[4]

 فنقول المريض إذا خاف على نفسه التلف، أو ذهاب عضو منه يفطر بالإجماع، وإن خاف زيادة العلة وامتداده، فكذلك عندنا، وعليه القضاء إذا أفطر لقوله تعالى: {ومن كان مريضاً أو على سفر، فعدة من أيام أخر} (البقرة: 185)

ولنا: أن هذا مفطر يرجى له القضاء فلا يلزمه الفداء كالمريض والمسافر وهذا لأن الفدية مشروعة خلفا عن الصوم والجمع بين الخلف والأصل لا يكون وهو خلف غير معقول بل هو ثابت بالنص في حق من لا يطيق الصوم فلا يجوز إيجابه في حق من يطيق الصوم

(والشيخ الفاني الذي لا يقدر على الصيام) لقربه إلى الفناء أو لفناء قوته (يفطر ويطعم لكل يوم مسكيناً كما يطعم) المكفر (في الكفارات) وكذا العجوز الفانية. والأصل فيه قوله تعالى: {وعلى الذين يطيقونه فدية طعام مسكين} معناه "لا يطيقونه" ولو قدر بعد على الصوم يبطل حكم الفداء، لأن شرط الخليفة استمرار العجز. هداية.
