Title: Foster Siblings Living Together

Question

 

Can foster brother and sister live togather in a same house?

Answer

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

In principle, a boy and a girl who are related through radha‘a (kinship created through breastfeeding) are like a real brother and sister. It is permissible for a brother and sister to live in the same house. However, if there is any fear of fitna (corruption or immorality), they should not live alone together.[1]

النتف في الفتاوى للسغدي (١/٢٥٤)  

مَا يحرم بِالرّضَاعِ

فَأَما الرَّضَاع فَيحرم مِنْهُ مَا يحرم بِالنّسَبِ من ذَوي الرَّحِم الْمحرم

بدائع الصنائع في ترتيب الشرائع (٥/١٢١)

(وأما) النوع الرابع وهو ذوات المحرم بلا رحم فحكمهن حكم ذوات الرحم المحرم وقد ذكرناه والأصل فيه قول النبي - عليه الصلاة والسلام - «يحرم من الرضاع ما يحرم من النسب»

فأما إذا كان يشتهي أو كان غالب ظنه وأكبر رأيه أنه لو نظر أو مس اشتهى لم يجز له النظر والمس لأنه يكون سببا للوقوع في الحرام فيكون حراما

المحيط البرهاني في الفقه النعماني (٥/٣٣٢)

 إنما يباح النظر إذا كان يأمن على نفسه الشهوة، فأما إذا كان يخاف على نفسه الشهوة، فلا يحل له النظر لما بينا قبل هذا، وكذلك المس إنما يباح له إذا أمن على نفسه وعليها الشهوة؛
