Title: Iddah of Khula


Assalamualaikum sir, I was married in the month of may, on the first two days we had physical relationship, but after the two days of marriage he started ignoring me. I thought he is possessed by a Jin, and did everything to solve it, read surah bakhrah many times, every dua of Jin, manzil blowed on water n gave to him, kept fasts but nothing worked, he used to fight n torture me with no reasons, he used to stay whole nights outside n sleep complete day at home in the mornings.

N after 1 and half month I went to my parents place, n he said to leave him or else live in the current situation, many people tried to tell him n ask him the problem. From the day 3 of marriage to October we tried to solve it. Finally taken khula on November 22, n he happily agreed to give me khula.

Mehr was 31000, BT he dint gave me 1 rupee, I was told that if I don't forgive mehr I cannot get khula, or else I will be in his nikaah, with forgiving his meher I had khula with my husband's approval. Now 1 month finished, do I need to do 3 month iddath or 1 month is fine

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

Sister in Islaam,

Almighty Allaah says:

فعسى أن تكرهوا شيئا ويجعل الله فيه خيرا كثيرا

Translation: “Perhaps you may dislike something but Allaah has placed plentiful good in it.” (An-Nisaa v.19)

It appears the khula’ subsequent to the difficult days of marriage is better for you. May Allaah Ta’aala grant you happier days in the future. Aameen.

Khula’ is when the wife requests for divorce in exchange of returning/forfeiting her mahr. If your husband agreed to give you of 31000 rupees and you requested khula’, it means you agreed to forfeit your mahr in exchange of talaaq. The khula’ constitutes a talaaq baain (one irrevocable divorce). Your ‘iddah commences from the time you agreed on the khula’. Your ‘iddah is not three months. It is three menstrual cycles if you are not pregnant. If you are pregnant then your ‘iddah is until you give birth[1].

مختصر القدوري (ص: 163) 

إذا اشتاق الزوجان وخافا أن لا يقيما حدود الله فلا بأس أن تفتدي نفسها منه بمال يخلعها به فإذ فعل ذلك وقع بالخلع تطليقة بائنة ولزمها المال


الهداية في شرح بداية المبتدي (2/ 261) 

" وإذا تشاق الزوجان وخافا أن لا يقيما حدود الله فلا بأس بأن تفتدي نفسها منه بمال يخلعها به " لقوله تعالى: {فَلا جُنَاحَ عَلَيْهِمَا فِيمَا افْتَدَتْ بِهِ} [البقرة: 229] " فإذا فعلا ذلك وقع بالخلع تطليقة بائنة ولزمها المال " لقوله عليه الصلاة والسلام: " الخلع تطليقة بائنة " ولأنه يحتمل الطلاق حتى صار من الكنايات والواقع بالكنايات بائن إلا أن ذكر المال أغنى عن النية هنا ولأنها لا تسلم المال إلا لتسلم لها نفسها وذلك بالبينونة "


البناية شرح الهداية (5/ 508) 

م: (وقع بالخلع تطليقة بائنة ولزمها المال) ش: وهو قول عثمان، وعلي، وابن مسعود، والحسن، وابن المسيب، وعطاء، وشريح، والشعبي، وقبيصة بن ذؤيب ومجاهد، وأبي سلمة، والنخعي، والزهري، والأوزاعي، والثوري، ومكحول، وابن أبي نجيح، وعروة، ومالك، والشافعي في الجديد، وعليه الفتوى، ذكره في " المبسوط ".

وقالت الظاهرية: تطليقة رجعية، حتى لو راجعها رد عليها ما أخذه وقال أحمد وإسحاق بن راهويه: فرقة بغير طلاق، وهو قول ابن عباس والشافعي في القديم، قيل: ذكرت الشافعية أن الشافعي غسل كتبه القديمة وأشهد على نفسه بالرجوع عنها، فمن جعلها مذهباً فقد كذب عليه، قاله إمام الحرمين وغيره ما قال إن الفتوى عليه في القديم في خمسة عشر مسألة، فذلك بالاجتهاد منهم، ولم ينسبه إلى الشافعي - رَحِمَهُ اللَّهُ تَعَالَى -.


العناية شرح الهداية (4/ 211) 

في الشريعة عبارة عن أخذ مال من المرأة بإزاء ملك النكاح بلفظ الخلع. وشرطه شرط الطلاق. وحكمه وقوع الطلاق البائن. وصفته أنه من جانب المرأة معاوضة على قول أبي حنيفة ويمين من الجانبين عندهما
