Title: Is there anything different in performing qadha witr?

Question

I have concern about Witr Qadha. If I intended to wake up for witr at night and and when I woke up its already Fajar Jamat time. So whats the procedure to pray Witr Qadha. 

If I want to pray Qadha of Witr after Zuhur Prayers so would I pray 3 rakat witr as usual with only difference of Niyat as Qadha or in a different way.

I have read in forum that you have to pray 4 rakat witr if you praying Qadha. In such 4 rakat case, whats the method of praying? Dua qunoot in 3rd rakat and 4th rakat as normal?

Please guide me according to Hanafi fiqh.

Answer

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

The procedure for the qadha of witr is the same as when one performs the witr in its correct time. The qadha witr is three rakats with the dua of qunut in the third rakat before the ruku.[1]

ولو ترك الوتر عند وقته حتى طلع الفجر يجب عليه القضاء عند أصحابنا

 

الهداية في شرح بداية المبتدي (1/ 66)

" الوتر واجب عند أبي حنيفة رحمه الله وقالا سنة " لظهور آثار السنن فيه حيث لا يكفر جاحده ولا يؤذن له ولأبي حنيفة رحمه الله تعالى قوله عليه الصلاة والسلام " إن الله تعالى زادكم صلاة ألا وهي الوتر فصلوها ما بين العشاء إلى طلوع الفجر " أمر وهو للوجوب ولهذا وجب القضاء بالإجماع

 

فتح القدير - ط. الفكر (1/ 426)

قوله ولهذا وجب القضاء بالإجماع أي ثبت وإلا فوجوب القضاء محل النزاع أيضا والمعنى أنه صلاة مقضية مؤقتة فتجب كالمغرب
