Title: Qaza Namaz

Question

as salamaulaikum

 

a person wishes to offer his qaza namaz that he has missed since he became an adult

but can't recall at what age he became an adult.

from whatage should he calculate his missed namaz?

 

Answer

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh. 

In principle, a person becomes an adult when he experiences wet dreams.

If one experiences wet dreams before the age of 15 lunar[1] years, he is an adult and obliged to follow the laws of Shariah. He will have to perform Salah and fast in Ramadan.

If one did not experience a wet dream before 15 lunar years, he will be regarded as an adult upon 15 lunar years. The person should apply his honest decision and decide accordingly.

If he cannot make a decision then he may use the age of 15 as his measure of adulthood[2].

[1] لَقَدْ جَعَل الشَّارِعُ الْبُلُوغَ أَمَارَةً عَلَى تَكَامُل الْعَقْل؛ لأَِنَّ الاِطِّلاَعَ عَلَى تَكَامُل الْعَقْل مُتَعَذِّرٌ، فَأُقِيمَ الْبُلُوغُ مَقَامَهُ. وَقَدِ اخْتُلِفَ فِي سِنِّ الْبُلُوغِ: فَيَرَى الشَّافِعِيَّةُ وَالْحَنَابِلَةُ (2) وَأَبُو يُوسُفَ وَمُحَمَّدٌ مِنَ الْحَنَفِيَّةِ، وَبِرَأْيِهِمَا يُفْتَى فِي الْمَذْهَبِ، وَالأَْوْزَاعِيُّ، أَنَّ الْبُلُوغَ بِالسِّنِّ يَكُونُ بِتَمَامِ خَمْسَ عَشْرَةَ سَنَةً قَمَرِيَّةً لِلذَّكَرِ وَالأُْنْثَى (تَحْدِيدِيَّةٌ كَمَا صَرَّحَ الشَّافِعِيَّةُ) ، لِخَبَرِ ابْنِ عُمَرَ. عُرِضْتُ عَلَى النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ يَوْمَ أُحُدٍ وَأَنَا ابْنُ أَرْبَعَ عَشْرَةَ سَنَةً، فَلَمْ يُجِزْنِي وَلَمْ يَرَنِي بَلَغْتُ، وَعُرِضْتُ عَلَيْهِ يَوْمَ الْخَنْدَقِ وَأَنَا ابْنُ خَمْسَ عَشْرَةَ سَنَةً، فَأَجَازَنِي، وَرَآنِي بَلَغْتُ. رَوَاهُ ابْنُ حِبَّانَ، وَأَصْلُهُ فِي الصَّحِيحَيْنِ (3) قَال الشَّافِعِيُّ: رَدَّ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ سَبْعَةَ عَشَرَ مِنَ الصَّحَابَةِ وَهُمْ أَبْنَاءُ أَرْبَعَ عَشْرَةَ سَنَةً، لأَِنَّهُ لَمْ يَرَهُمْ بَلَغُوا، ثُمَّ عُرِضُوا عَلَيْهِ وَهُمْ أَبْنَاءُ خَمْسَ عَشْرَةَ، فَأَجَازَهُمْ

"ولمن بلغ بالسن" احترز به عن بلوغ الصبي بالإحتلام والإحبال والإنزال وعن بلوغ الصبية بالإحتلام والحيض والحبل فإنه لا بد من الغسل فيها قوله: "وهو خمس عشرة سنة على المفتي به" وهو قولهما ورواية عن الإمام إذ العلامة تظهر في هذه المدة غالبا فجعلوا المدة علامة في حق من لم تظهر له العلامة وأدنى مدة يعتبر فيها ظهور العلامة إثنتا عشر سنة في حقه وتسع سنين في حقها فإذا بلغا هذا السن وأقرا بالبلوغ كانا بالغين حكما لأن ذلك مما يعرف من جهتهما
