Title: Can I keep non-Muslims to run my business during Jumah time?

Question

As Salamu Alaikum

I own a few furniture retail outlets in mulitle towns.

Is is compulsory for me to close during Jumaah hours on a Friday?

Majority of my staff are non muslim.

Currently on a Friday, all muslim staff are given time off from 12-2 pm. The store in which I am based closes from 12-2pm.

Please advise.

Answer

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

It is not compulsory to close your shop during Jummah time. Your non-muslim employees may continue working at the shop at that time[1].

هو قوله تعالى{إِذَا نُودِيَ لِلصَّلاةِ مِنْ يَوْمِ الْجُمُعَةِ فَاسَعَوْا إِلَى ذِكْرِ اللَّهِ وَذَرُوا الْبَيْعَ} [الجمعة: 9] رتب الأمر بالسعي إلى ذكر الله على النداء للصلاة والظاهر أن المراد بالذكر الصلاة ويجوز أن يراد به الخطبة وعلى كل تقدير يفيد افتراض الجمعة فالأول ظاهر والثاني كذلك لأن افتراض السعي إلى الشرط فرع افتراض المشروط ألا ترى أن من لم تجب عليه الصلاة لم يجب عليه السعي إلى الخطبة بالإجماع

و في صفحة 517

بأن من لم تجب عليه الجمعة مستثنى من الحكم كما في القهستاني
