Title: Selling third party insurance

Question

Assalamualiekum,

Hoping you are doing good. My question relates to selling insurance. I own a tire shop in which cars for them to get their car plate for the year they have to pass a checking from any of the authorized auto repair shops. I offer the service of checking the car and telling weather is in good condition or not to get the plate. At the same time for them to get the plate by law they are required to have third party insurance, so I sell them the third party insurance too and make a profit of it.

My question is it is halal for me to sell my clients the third party insurance, which is required by law, and make a profit of it? as this is a complement to my business where all the clients look a place where they can do everything in one place.

If the answer is that is not permissible, will it be allowed for me to sell them the insurance without making a profit of it? Just as a service?

If the answer is still no, can you tell me a halal way of my clients getting their mandatory insurance in my company any suggestions or ideas?

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

Third-party insurance, like all other forms of conventional insurances is not permissible.[1] It is not permissible for you to sell the third-party insurance with or without profit.[2]

[1] الَّذِينَ يَأْكُلُونَ الرِّبَا لَا يَقُومُونَ إِلَّا كَمَا يَقُومُ الَّذِي يَتَخَبَّطُهُ الشَّيْطَانُ مِنَ الْمَسِّ ذَٰلِكَ بِأَنَّهُمْ قَالُوا إِنَّمَا الْبَيْعُ مِثْلُ الرِّبَا وَأَحَلَّ اللَّـهُ الْبَيْعَ وَحَرَّمَ الرِّبَا فَمَن جَاءَهُ مَوْعِظَةٌ مِّن رَّبِّهِ فَانتَهَىٰ فَلَهُ مَا سَلَفَ وَأَمْرُهُ إِلَى اللَّـهِ وَمَنْ عَادَ فَأُولَـٰئِكَ أَصْحَابُ النَّارِ هُمْ فِيهَا خَالِدُونَ

يَا أَيُّهَا الَّذِينَ آمَنُوا إِنَّمَا الْخَمْرُ وَالْمَيْسِرُ وَالْأَنصَابُ وَالْأَزْلَامُ رِجْسٌ مِّنْ عَمَلِ الشَّيْطَانِ فَاجْتَنِبُوهُ لَعَلَّكُمْ تُفْلِحُونَ

﴿المائدة: ٩٠﴾

عن جابر قال لعن رسول الله صلى الله عليه وسلم آكل الربا وموكله وكاتبه وشاهديه وقال هم سواء

عن جابر رضي الله عنه قال لعن رسول الله صلى الله عليه وسلم آكل الربا وموكله وكاتبه وشاهديه وقال هم سواء رواه مسلم

عن أبي هريرة عن رسول الله صلى الله عليه وسلم قال ليأتين على الناس زمان لا يبقى أحد إلا أكل الربا فإن لم يأكله أصابه من بخاره ويروى من غباره رواه أحمد وأبو داود والنسائي وابن ماجه

وعن عبد الله بن حنظلة غسيل الملائكة قال قال رسول الله صلى الله عليه وسلم درهم ربا يأكله الرجل وهو يعلم أشد من ستة وثلاثين زنية رواه أحمد والدراقطني وروى البيهقي في شعب الإيمان عن ابن عباس وزاد وقال من نبت لحمه من السحت فالنار أولى به

 

[2] وَتَعَاوَنُوا عَلَى الْبِرِّ وَالتَّقْوَى وَلَا تَعَاوَنُوا عَلَى الْإِثْمِ وَالْعُدْوَانِ

 ﴿المائدة: ٢﴾

وهذا إنما يقع على من واطأ صاحب الربا عليه فأما من كتبه أو شهد القصة ليشهد بها على ما هي عليه ليعمل فيها بالحق فهذا جميل القصد لا يدخل في الوعيد المذكور وإنما يدخل فيه من أعان صاحب الربا بكتابته وشهادته

(وَكَاتِبَهُ وَشَاهِدَيْهِ) : قَالَ النَّوَوِيُّ: فِيهِ تَصْرِيحٌ بِتَحْرِيمِ كِتَابَةِ الْمُتَرَابِيَيْنِ وَالشَّهَادَةِ عَلَيْهِمَا وَبِتَحْرِيمِ الْإِعَانَةِ عَلَى الْبَاطِلِ
