Title: Will divorce occur?

Question

Urgent Question Please answer this question quickly as its causing lots of stress and tension. I asked this question on 19th September and still waiting for reply. I added question no 2 now to the old post. 1. The husband and wife were having argument related to how to handle their child politely and the husband got angry and said to his wife if you guys don't want me here I wont stay here or I go. Later on when the wife asked the intention of what he said then he told that he didn't have any bad intention but what he said was just a question and said that i only said " if you dont want me and there is difference between I do ( that I go somewhere)and if u want i would go" And husband also told that he never had any bad intention ( meaning no intention of divorce). The wife then said if next time God forbid ( wife meant to say that if there's again confusion or waswasa in wife's mind ) just say No Bad intention and don't elaborate on meaning of words as its risky and scary thing (wife meant that its too risky to talk about divorce issue) The husband said ok. 2. Once wife said to husband long time ago if therez some separation or divorce (but don't remember using the word divorce)happens between husband and wife it will be due to religious issues ( as husband is very liberal and having non muslim friends n used to force wife to go gheir events like weddings n other parties). To that husband said ok or hmm ( but wife dont remember whether he responded to that question or said ok or hmm or nodded his head as it was long time ago). The husband may not have responded or just heard or might have said hmm. Is Nikkah still valid? JazakAllah khair

Answer

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

The nikah in reference is valid and in both references in the enquiry, divorce did not take place.[i]

الكنايات إذا نوى بها الطلاق كانت واحدة بائنة وإن نوى ثلاثا كانت بثلاث وإن نوى ثنتين كانت واحدة بائنة وهذا مثل قوله أنت بائن وبتة وبتلة وحرام وحبلك على غلوبك الحقي بأهلك وخلية وبرية ووهبتك لأهلك وسرحتك وفارقتك وأمرك بيدك واختاري وأنت حرة وتقنعي وتخمري واستتري واغربي واخرجي واذهبي وقومي وابتغي الأزواج " لأنها تحتمل الطلاق وغيره فلا بد من النية.
