Title: Tawaaf Az-Ziyaarah

Question

URGENT!!! Please!

A question regarding tawaf e ziarat and wudo.

My wife and I did tawaf e ziarat  and saee on 10 th dhul hijja.

When I got back from the hotel to take a shower I noticed some impurities in my trouser. At that time i was certain the impurities did not come while I was doing tawaf nor doing saee.

After tawaf e ziarat and saee we took a break, before eating I had the urge to empty my bowl, so I did that and as I recall I didn't notice any stains of impurity on my white trouser. But beacuse I didn't have any suspicion I didn't check thoroughly.

Now since two days I am having these incredible doubts about invalid tawaf e ziarat. Can't stop thinking about it. The thought are just growing and growing. What if these impurities got there during tawaf? Should I give dam? Is my hajj incomplete?

Please advise me what to do.. Iam still in Makkah

In the Name of Allaah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

Brother in Islaam,

You state that you were certain that the impurities did not come while performing tawaaf or sa’ee and you did not notice any stains thereafter when relieving yourself. Accordingly, the impurities came afterwards. Hence, your tawa­afuz ziyaarah was valid and your Hajj is complete[1]. You should not entertain any further doubts.

الْيَقِينُ لَا يَزُولُ بِالشَّكّ.

الْأَصْلُ بَقَاءُ مَا كَانَ عَلَى مَا كَانَ. وَتَتَفَرَّعُ عَلَيْهَا مَسَائِلُ مِنْهَا: مَنْ تَيَقَّنَ الطَّهَارَةَ وَشَكَّ فِي الْحَدَثِ فَهُوَ مُتَطَهِّرٌ.

وَلَا بَأْس بِأَن يطوف وَعَلِيهِ خفاه أَو نعلاه إِذا كَانَا طاهرين وَإِن كَانَ عَلَيْهِ ثوب فِيهِ دم أَو بَوْل أَكثر من قدر الدِّرْهَم كرهت لَهُ ذَلِك وَلم يكن عَلَيْهِ شَيْء.

فأما الطهارة عن النجس فليست من شرائط الجواز بالإجماع فلا يفترض تحصيلها، ولا تجب أيضا لكنه سنة حتى لو طاف، وعلى ثوبه نجاسة أكثر من قدر الدرهم جاز، ولا يلزمه شيء إلا أنه يكره.

 

حاشية ابن عابدين (رد المحتار) (2/ 550)

(قوله أو للفرض محدثا) قيد بالحدث لأن الطواف مع نجاسة الثوب أو البدن مكروه فقط. وما في الظهيرية من إيجاب الدم في نجاسة كل الثوب لا أصل له في الرواية،
