Title: Does waswasa constitute talaq?

Question

AssalamoAlaikum The wife has lots of waswasas and having bad thoughts without intention which is causing lots of stress. 1. If a wife thinks in mind that if her husband says yes to general question asked by her which is not related to divorce may constitute divorce ( she thinks in her mind and husband is unaware of those thoughts in wife's mind. Wife also doesn't have intention of seeking divorce, just having bad thoughts) does it constitute divorce? Note that husband has no ideas of thoughts in wife's mind and never said directly or indirectly words relating to divorce. Its just wife's waswasas which she denies in mind. She thinks if he says yes to general questions the divorce may take place only because of bad thoughts abt divorce comes to her mind. From the research on internet I have found that wife's intention doesnot matter the right is with the husband not wife. 2. Does researching about divorce relating matters to get answers to questions in mind cause divorce? JazakAllah khair

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

The right of divorce belongs to the husband. If the husband says yes to something the wife’s interpretation of divorce is her waswasa. That does not constitute divorce.[1] The wife should avoid the waswasa and also seek medical help. When she experiences waswasa, she should recite: 

أعوذ بكلمات الله التامات من شر ما خلق

Transliteration:

'A'udhu bikalimat-illahit-tammati min sharri ma khalaqa

Translation:

I seek refuge with the Perfect Words of Allah from the evil of what He has created

.

 

لاَ حَوْلَ وَلاَ قُوَّةَ إِلاَّ بِاللَّه

Transliteration:

 La hawla wa la quwwata illa billah

Translation:

 There is no power and no strength except with Allah.

And Allah Ta’āla Knows Best
