Title: Divorce query

Question

Salaam alaykum wa rahmatullah,

I got married in August 15th 2016 and within the first week of marriage I saw a text message on my wifes' phone which made me really angry as it revealed her past to me, so we had a heated discussion and I said to her, "look, if you crash my car I can take it, if you burn my house I can take it, if you waste all of my money i can take it but if you chat with any guy behind my back then I have nothing to do with you" and by "then I have nothing to do with you" I meant divorce.

In 1st February 2017, I came across my wife's phone records and I saw that she had been on phone to 2 different men behind my back in every month between from August 2016 - January 2017 and she admitted to all of this as well when I confronted her.

So my 2 questions are;

1. Has talaaq taken place here?

2. If so, when did it take place, when I found out which was in February 2017 or when it first happened behind my back in the end of August 2016?

Brother in Islaam,

  1. Your statement “I have nothing to do with you” will constitute a talaaq baain as you intended divorce[1].
  2. The divorce took place when your wife chatted with another man in August 2016[2].

وَلَا خِلَافَ أَنَّهُ لَا يَقَعُ الطَّلَاقُ بِشَيْءٍ مِنْ أَلْفَاظِ الْكِنَايَةِ إلَّا بِالنِّيَّةِ فَإِنْ كَانَ قَدْ نَوَى الطَّلَاقَ يَقَعُ فِيمَا بَيْنَهُ وَبَيْنَ اللَّهِ تَعَالَى، وَإِنْ كَانَ لَمْ يَنْوِ لَا يَقَعُ فِيمَا بَيْنَهُ وَبَيْنَ اللَّهِ تَعَالَى، وَإِنْ

ذَكَرَ شَيْئًا مِنْ ذَلِكَ ثُمَّ قَالَ: مَا أَرَدْتُ بِهِ الطَّلَاقَ يُدَيَّنُ فِيمَا بَيْنَهُ وَبَيْنَ اللَّهِ تَعَالَى؛ لِأَنَّ اللَّهَ تَعَالَى يَعْلَمُ سِرَّهُ وَنَجَوَاهُ

والطلاق على ضربين: صريح وكناية فالصريح قوله: أنت طالق ومطلقه وطلقتك فهذا يقع به الطلاق الرجعي ولا يقع به إلا واحدة وإن نوى أكثر من ذلك ولا يفتقر إلى النية

وقوله: أنت الطلاق أو أنت طالق الطلاق أو أنت طالق طلاقا فإن لم تكن له نية فهي واحدة رجعية وإن نوى به ثلاثا كان ثلاثا

والضرب الثاني: والكنايات ولا يقع بها الطلاق إلا بينة أو دلاله حال

 

 

اللباب في شرح الكتاب (3/ 41)

(والضرب الثاني الكنايات) وهي: مالم يوضع له واحتمله وغيره (ولا يقع بها الطلاق إلا بنية أو دلالة حال) من مذاكرة الطلاق، أو وجود الغضب لأنها غير موضوعة للطلاق، بل تحتمله وغيره، فلابد من التعيين أو دلالته، لأن الطلاق لا يقع بالاحتمال

وإذا أضافه إلى شرط وقع عقيب الشرط مثل أن يقول لامرأته: إن دخلت الدار فأنت طالق، وهذا بالاتفاق 

 

اللباب في شرح الكتاب (3/ 46) 

(وإذا أضافه) أي الطلاق (إلى) وجود (شرط وقع عقيب) وجود (الشرط) وذلك (مثل أن يقول لامرأته: إن دخلت الدار فأنت طالق) ، وهذا بالاتفاق، لأن الملك قائم في الحال، والظاهر بقاؤه إلى وقت الشرط، ويصير عند وجود الشرط كالمتكلم بالطلاق في ذلك الوقت
