Title: Is family tax benefit permissible?

Question

Assalamo Alaikum warahmatullahi wabarakatuhu

I have two questions,

 

1) In Australia, Family Tax benefit can be applied by a couple with single income. The government pays fortnightly to meet the children's needs.

Family Tax benefit A & B.

One of them requires that a child has be immunized as per government's plan. Since I haven't done it, I am not eligible for it. As for the other one, if I am eligible, is there any harm in getting Family Tax benefit, or is there any harm in not taking it, if it is due to us??

 

2) Can you please confim if the following is a hadith and what its source is

A woman came to Rasullah (sallallahu 'alayhi wasallam) and complained to him about her husband that he invites too manu guests and she has become weary from preparing food for them and hosting them. Rasulullah (sallallahu 'alayhi wasallam) did not answer and the woman left.

Sometime later Rasulullah (sallallahu 'alayhi wasallam) called the woman's husband and said, "I am you guest today". The man was so happy he went home and told his wife "Rasulullah (sallallahu 'alayhi wasallam) is our guest today". His wife was ecstatic and spent time and effort and used every bit of food to prepare for the arrival of the Most Honoured Guest, Rasulallah (sallallahu 'alayhi wasallam).

After the amazing joy of hosting Rasulullah (sallallahu 'alayhi wasallam) generously Rasulullah (sallallahu 'alayhi wasallam) told the man, 'tell you wife to watch the door from which I leave your home".

So the wife watched the door from which Rasulullah (sallallahu 'alayhi wasallam) left her home and saw all kinds of creatures, scorpions and other harmful creatures leaving the house behind Rasulullah (sallallahu 'alayhi wasallam) upon which she fainted due to the immense manisfestation and greatness of what she had witnessed.

When she came to Rasulullah (sallallahu 'alayhi wasallam), he said to her, "this is what happens when the guest leaves you home, with him all kinds of harm, trials and tribulations and harmful creatures depart from you home, and that is the wisdom behind being generous to one's guest and becoming weary doing so".

Answer

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

 

1)    If the family tax benefit A, requires you to immunize your child, you may do so on condition there is no haram ingredients in the immunization.

If you are eligible for family tax benefit B, there is no harm in accepting the tax benefits or refusing the tax benefit. If one is in need of the family tax benefit, he should not harm himself by refusing  the family fax benefit [1].

 

2)    The virtues of hosting guests and being generous are many.

Consider the following Ahaadeeth

وعن عبد الله بن عمرو بن العاص رضي الله عنهما أن رجلا سأل رسول الله صلى الله عليه وسلم‏:‏ أي الإسلام خير‏؟‏ قال‏:‏ ‏ "‏تطعم ‏الطعام، وتقرأ السلام على من عرفت ومن لم تعرف‏"‏‏.‏

Abdullah bin 'Amr bin Al-'as (رضي الله عنهما) reported: A man asked the Messenger of Allah (ﷺ): "Which act in Islam is the best?" He (ﷺ) replied, "To give food, and to greet everyone, whether you know or you do not."‎ ‎[Al-Bukhari and Muslim].

 

عَنْ أَنَسِ بْنِ مَالِكٍ قَالَ: قَالَ رَسُولُ اللهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: "إِنَّ الصَّدَقَةَ لَتُطْفِئُ غَضَبَ الرَّبِّ وَتَدْفَعُ مِيتَةَ السُّوءِ"

Anas bin Malik(رضي الله عنه) narrated that : the Messenger of Allah(صلى الله عليه و سلم) said: "Indeed charity extinguishes the Lord's anger and it protects against the evil death." [Tirmithy]

 

We have not come across the Hadeeth in reference. However, feeding guests is a form of Sadaqah that wards of difficulties as understood in the above quoted Hadeeth.

ولا بأس أن يصل المسلم المشرك قريباً كان أو بعيداً، محارباً كان أو ذمياً، وأراد بالمحارب المستأمن، فأما إذا كان غير ‏مستأمن فلا ينبغي بأن يصله بشيء، والأصل في ذلك قوله تعالى {لا ينهاكم الله عن الذين لم يقاتلو في الدين} (الممتحنه: 8) ‏الآية إلى آخرها، فالله تعالى بين بأول الآية أنه ما نهانا عن مبرة الذمي، وبين بآخر الآية أنه نهانا عن مبرة أهل الحرب؛ إلا ‏أن المستأمن صار مخصوصاً عن آخر الآية؛ لأن الأمان المؤبد أو المؤقت خلف عن الإسلام في أحكام الدنيا، فكما لا يكون ‏بصلة المسلم بأساً، فلا يكون بصلة المستأمن بأساً؛ بخلاف غير المستأمن؛ لأنه لم يوجد في حقه ما هو خلف عن الإسلام؛ ‏حتى يلحق بالمسلم في حق هذا الحكم، فبقي داخلاً تحت النهي؛ هذا هو الكلام في صلة المسلم المشرك‎.‎

جئنا إلى صلة المشرك المسلم، فقد روى محمد رحمه الله في «السير الكبير» أخباراً متعارضة في بعضها أن رسول الله ‏صلى الله عليه وسلم قبل هدايا المشرك، وفي بعضها أنه لم يقبل، فلابد من التوفيق، واختلفت عبارة المشايخ في وجه ‏التوفيق، فعبارة الفقيه أبي جعفر الهندواني أن ما روي أنه لم يقبلها محمول على أنه لم يقبلها من شخص غلب على ظن ‏رسول الله عليه السلام أنه وقع (93ب2) عند ذلك الشخص أن رسول الله عليه السلام إنما يقاتلهم طمعاً في المال؛ لا لإعلاء ‏كلمة الله، ولا يجوز قبول الهدية من مثل هذا الشخص في زماننا، وما روي أنه قبلها محمول على أنه قبل من شخص غلب ‏على ظن رسول الله أنه وقع عند ذلك الشخص أن رسول الله عليه السلام إنما يقاتلهم لإعزاز الدين، وإعلاء كلمة الله لا لطلب ‏المال، وقبول الهدية من مثل هذا الشخص جائز في زماننا أيضاً؛ لأن قبول الهدية حينئذٍ لا يكون لترك القتال بل للتألف وإنه ‏جائز‎.‎
