Title

Is listening to the Jumah bayaan a condition for the validity of Jumah salaah?

Question

Asalaamu Alaykum,


If you miss the jumah bayan, but get there in time for the start of the salah.  Will you jumah be valid?

Or is the bayaan part of the salah and therefore your jumah would not be complete?

Answer

In the Name of Allah, the Most Gracious, The Most Merciful.

As-salaamu `alaykum wa-ramatullahi wa-barakatuh.

You refer to Jumah bayaan and salaah. You did not refer to the khutba which is given before the salaah. The khutba on a Friday is wajib and is ought to be in Arabic. It is compulsory to listen to the Arabic khutba before the Jumah salaah. The official wajib khutba cannot be in English. If one did not listen to the Arabic khutba he will be sinful.

In many places, there is an English talk (bayaan) given before the Arabic khutba. The English talk is not a requirement for the validity of the Jumah salaah. However, it is advisable to listen to the English bayaan and benefit from the advises.[1]

(و) منع أيضا عن التنفل (وقت الخطبة) أي خطبة كانت أعني سواء كانت الجمعة الجمعة أو عيدا أو استسقاء أو حج أو ختم قرآن أو نكاح لما فيه من الاشتغال بسماع الخطبة وصرح في المجتبى بأن الاستماع إلى خطبة النكاح والختم وسائر الخطب واجب

 

بدائع الصنائع في ترتيب الشرائع (1/ 264)

وَكَذَا كُلُّ مَا شَغَلَ عَنْ سَمَاعِ الْخُطْبَةِ مِنْ التَّسْبِيحِ وَالتَّهْلِيلِ وَالْكِتَابَةِ وَنَحْوِهَا بَلْ يَجِبُ عَلَيْهِ أَنْ يَسْتَمِعَ وَيَسْكُتَ وَأَصْلُهُ قَوْله تَعَالَى {وَإِذَا قُرِئَ الْقُرْآنُ فَاسْتَمِعُوا لَهُ وَأَنْصِتُوا} [الأعراف: 204] قِيلَ نَزَلَتْ الْآيَةُ فِي شَأْنِ الْخُطْبَةِ أَمَرَ بِالِاسْتِمَاعِ وَالْإِنْصَاتِ وَمُطْلَقُ الْأَمْرِ لِلْوُجُوبِ.

 

بدائع الصنائع في ترتيب الشرائع (1/ 266)

وَأَمَّا بَيَانُ كَيْفِيَّةِ هَذَا الشَّرْطِ فَنَقُولُ: لَا خِلَافَ فِي أَنَّ الْجَمَاعَةَ شَرْطٌ لِانْعِقَادِ الْجُمُعَةِ حَتَّى لَا تَنْعَقِدَ الْجُمُعَةُ بِدُونِهَا حَتَّى إنَّ الْإِمَامَ إذَا فَرَغَ مِنْ الْخُطْبَةِ ثُمَّ نَفَرَ النَّاسُ عَنْهُ إلَّا وَاحِدًا يُصَلِّي بِهِمْ فِي الظُّهْرِ دُونَ الْجُمُعَةِ، وَكَذَا لَوْ نَفَرُوا قَبْلَ أَنْ يَخْطُبَ الْإِمَامُ فَخَطَبَ الْإِمَامُ وَحْدَهُ ثُمَّ حَضَرُوا فَصَلَّى بِهِمْ الْجُمُعَةَ لَا يَجُوزُ؛ لِأَنَّ الْجَمَاعَةَ كَمَا هِيَ شَرْطُ انْعِقَادِ الْجُمُعَةِ حَالَ الشُّرُوعِ فِي الصَّلَاةِ فَهِيَ شَرْطُ حَالِ سَمَاعِ الْخُطْبَةِ؛ لِأَنَّ الْخُطْبَةَ بِمَنْزِلَةِ شَفْعٍ مِنْ الصَّلَاةِ، قَالَتْ عَائِشَةُ - رَضِيَ اللَّهُ عَنْهَا - إنَّمَا قُصِرَتْ الْجُمُعَةُ لِأَجْلِ الْخُطْبَةِ فَتُشْتَرَطُ الْجَمَاعَةُ حَالَ سَمَاعِهَا كَمَا تُشْتَرَط حَالَ الشُّرُوعِ فِي الصَّلَاةِ، وَاخْتَلَفُوا فِي أَنَّهَا هَلْ هِيَ شَرْطُ بَقَائِهَا مُنْعَقِدَةً إلَى آخِرِ الصَّلَاةِ؟ قَالَ أَصْحَابُنَا الثَّلَاثَةُ: إنَّهَا لَيْسَتْ بِشَرْطٍ، وَقَالَ زُفَرُ: إنَّهَا شَرْطٌ لِلِانْعِقَادِ وَالْبَقَاءِ جَمِيعًا فَيُشْتَرَطُ دَوَامُهَا مِنْ أَوَّلِ الصَّلَاةِ إلَى آخِرِهَا كَالطَّهَارَةِ وَسَتْرِ الْعَوْرَةِ وَاسْتِقْبَالِ الْقِبْلَةِ وَنَحْوِهَا، حَتَّى إنَّهُمْ لَوْ نَفَرُوا بَعْدَ مَا قَيَّدَ الرَّكْعَةَ بِالسَّجْدَةِ لَهُ أَنْ يُتِمَّ الْجُمُعَةَ عِنْدَنَا، وَعِنْدَ زُفَرَ إذَا نَفَرُوا قَبْلَ أَنْ يَقْعُدَ الْإِمَامُ قَدْرَ التَّشَهُّدِ فَسَدَتْ الْجُمُعَةُ وَعَلَيْهِ أَنْ يَسْتَقْبِلَ الظُّهْرَ.
