Title: Is my fast valid or not

Question

Salam Mufti Sahab, I had woken up laye for suhoor while the fajar adhan was going off and rushed to eat something while the adhan was being said. I wanted to know if my fast was valid or will i need to redo it? Second question is I have a biopsy coming up which will reuiqre an I.V. And and incision will be made to take a piece of my tissue should I fast that day or make it up later?

Answer

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

If the fajr azaan was correctly called out upon or after subh sadiq [true dawn] then the time has already commenced. It was incorrect to eat at that time and the fast will be invalid. Therefore, the fast has to be repeated. [qadha][1]

مَنْ وَجَبَ عَلَيْهِ الصَّوْمُ فِي أَوَّلِ النَّهَارِ لِوُجُودِ سَبَبِ الْوُجُوبِ وَالْأَهْلِيَّةِ ثُمَّ تَعَذَّرَ عَلَيْهِ الْمُضِيُّ فِيهِ بِأَنْ أَفْطَرَ مُتَعَمِّدًا أَوْ أَصْبَحَ يَوْمَ الشَّكِّ مُفْطِرًا ثُمَّ تَبَيَّنَ أَنَّهُ مِنْ رَمَضَانَ أَوْ تَسَحَّرَ عَلَى ظَنِّ أَنَّ الْفَجْرَ لَمْ يَطْلُعْ ثُمَّ تَبَيَّنَ لَهُ أَنَّهُ طَلَعَ فَإِنَّهُ يَجِبُ عَلَيْهِ الْإِمْسَاكُ فِي بَقِيَّةِ الْيَوْمِ تَشَبُّهًا بِالصَّائِمِينَ  

. لَنَا مَا رُوِيَ عَنْ النَّبِيِّ - صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ - «أَنَّهُ قَالَ فِي يَوْمِ عَاشُورَاءَ: إلَّا مَنْ أَكَلَ فَلَا يَأْكُلَنَّ بَقِيَّةَ يَوْمِهِ» وَصَوْمُ عَاشُورَاءَ كَانَ فَرْضًا يَوْمئِذٍ، وَلِأَنَّ زَمَانَ رَمَضَانَ وَقْتٌ شَرِيفٌ فَيَجِبُ تَعْظِيمُ هَذَا الْوَقْتِ بِالْقَدْرِ الْمُمْكِنِ، فَإِذَا عَجَزَ عَنْ تَعْظِيمِهِ بِتَحْقِيقِ الصَّوْمِ فِيهِ يَجِبُ تَعْظِيمُهُ بِالتَّشَبُّهِ بِالصَّائِمِينَ قَضَاءً لِحَقِّهِ بِالْقَدْرِ الْمُمْكِنِ إذَا كَانَ أَهْلًا لِلتَّشَبُّهِ وَنَفْيًا لِتَعْرِيضِ نَفْسِهِ لِلتُّهْمَةِ، وَفِي حَقِّ هَذَا الْمَعْنَى الْوُجُوبُ فِي أَوَّلِ النَّهَارِ وَعَدَمُ الْوُجُوبِ سَوَاءٌ

وَلِأَنَّ الْأَصْلَ فِي الْعِبَادَةِ الْمُؤَقَّتَةِ إذَا فَاتَتْ عَنْ وَقْتِهَا أَنْ تُقْضَى لِمَا ذَكَرْنَا فِي كِتَابِ الصَّلَاةِ، وَسَوَاءٌ فَاتَهُ صَوْمُ رَمَضَانَ بِعُذْرٍ أَوْ بِغَيْرِ عُذْرٍ لِأَنَّهُ لَمَّا وَجَبَ عَلَى الْمَعْذُورِ فَلَأَنْ يَجِبَ عَلَى الْمُقَصِّرِ أَوْلَى، وَلِأَنَّ الْمَعْنَى يَجْمَعُهُمَا وَهُوَ الْحَاجَةُ إلَى جَبْرِ الْفَائِتِ بَلْ حَاجَةُ غَيْرِ الْمَعْذُورِ أَشَدُّ.

فَأَمَّا إذَا تَسَحَّرَ وَأَكْبَرُ رَأْيِهِ أَنَّ الْفَجْرَ طَالِعٌ فَذَكَرَ فِي الْأَصْلِ وَقَالَ: إنَّ الْأَحَبَّ إلَيْنَا أَنْ يَقْضِيَ، وَرَوَى الْحَسَنُ عَنْ أَبِي حَنِيفَةَ أَنَّهُ يَقْضِي، وَذَكَرَ الْقُدُورِيُّ أَنَّ الصَّحِيحَ أَنَّهُ لَا قَضَاءَ عَلَيْهِ، وَجْهُ رِوَايَةِ الْأَصْلِ أَنَّهُ عَلَى يَقِينٍ مِنْ اللَّيْلِ فَلَا يَبْطُلُ إلَّا بِيَقِينٍ مِثْلِهِ.

وَجْهُ رِوَايَةِ الْحَسَنِ أَنَّ غَالِبَ الرَّأْيِ دَلِيلٌ وَاجِبُ الْعَمَلِ بِهِ بَلْ هُوَ فِي حَقِّ وُجُوبِ الْعَمَلِ فِي الْأَحْكَامِ بِمَنْزِلَةِ الْيَقِينِ.

وَعَلَى رِوَايَةِ الْحَسَنِ اعْتَمَدَ شَيْخُنَا - رَحِمَهُ اللَّهُ -.
