Title: Marriage between a Sunni and a Shia

Question

Mufti Shaib pls advised me Quran sunna about marriage between Sunni girl and Shia boy I appreciate your help thanks

Answer

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

Marriage is an extremely important step and a lifelong responsibility. It is a lifetime commitment in which a long-term relationship is established as a family. A marriage is a means of bringing comfort and joy to both spouses and raising righteous Muslim children. In choosing a spouse, all related issues must be carefully contemplated. When one is choosing a spouse, he is choosing a companion for the rest of his life. Hence, it is of utmost importance than one makes a constructive decision, deliberates every avenue and thinks for the long term.

In principle, if one has beliefs that are at variance with the Ahlu Sunnah Wal Jammah, it is not permissible to marry such a person. [1]

Islam and Shia’ism are two opposite streams of thought that can never converge. They are two separate religions with different ideologies.

The boy in reference should be advised to accept the true Islam by adopting the beliefs of the Ahlus Sunnah Wal Jamaah. If he is willing to change his views and accept the beliefs of the Ahlus Sunnah Wal Jamaah, then the Sunni girl can marry him. Otherwise, it is not permissible to marry someone who has views contrary to the teachings of the Ahlus Sunnah Wal Jamaah.

بدائع الصنائع في ترتيب الشرائع (2/ 270) [1]

 

وَمِنْهَا أَنْ لَا تَكُونَ الْمَرْأَةُ مُشْرِكَةً إذَا كَانَ الرَّجُلُ مُسْلِمًا، فَلَا يَجُوزُ لِلْمُسْلِمِ أَنْ يَنْكِحَ الْمُشْرِكَةَ؛ لِقَوْلِهِ تَعَالَى: {وَلا تَنْكِحُوا الْمُشْرِكَاتِ حَتَّى يُؤْمِنَّ} [البقرة: 221]

 

وَالْفَرْقُ أَنَّ الْأَصْلَ أَنْ لَا يَجُوزَ لِلْمُسْلِمِ أَنْ يَنْكِحَ الْكَافِرَةَ؛ لِأَنَّ ازْدِوَاجَ الْكَافِرَةِ وَالْمُخَالَطَةِ مَعَهَا مَعَ قِيَامِ الْعَدَاوَةِ الدِّينِيَّةِ لَا يَحْصُلُ السَّكَنُ وَالْمَوَدَّةُ الَّذِي هُوَ قِوَامُ مَقَاصِدِ النِّكَاحِ

وقد صَرَّحَ في الْخُلَاصَةِ وَالْبَزَّازِيَّةِ بِأَنَّ الرَّافِضِيَّ إذَا سَبَّ الشَّيْخَيْنِ وَطَعَنَ فِيهِمَا كَفَرَ وَإِنْ فَضَّلَ عَلِيًّا عَلَيْهِمَا فَمُبْتَدِعٌ ولم يَتَكَلَّمَا على عَدَمِ قَبُولِ تَوْبَتِهِ

 وفي الْجَوْهَرَةِ من سَبَّ الشَّيْخَيْنِ أو طَعَنَ فِيهِمَا كَفَرَ وَيَجِبُ قَتْلُهُ ثُمَّ إنْ رَجَعَ وَتَابَ وَجَدَّدَ الْإِسْلَامَ هل تُقْبَلُ تَوْبَتُهُ أَمْ لَا قال الصَّدْرُ الشَّهِيدُ لَا تُقْبَلُ تَوْبَتُهُ وَإِسْلَامُهُ وَنَقْتُلُهُ وَبِهِ أَخَذَ الْفَقِيهُ أبو اللَّيْثِ السَّمَرْقَنْدِيُّ وأبو نَصْرٍ الدَّبُوسِيُّ وهو الْمُخْتَارُ لِلْفَتْوَى اه

 وَحَيْثُ لَا تُقْبَلُ تَوْبَتُهُ عُلِمَ أَنَّ سَبَّ الشَّيْخَيْنِ كَسَبِّ النبي فَلَا يُفِيدُ الْإِنْكَارُ مع الْبَيِّنَةِ كما تَقَدَّمَ عن فَتْحِ الْقَدِيرِ لِأَنَّا نَجْعَلُ إنْكَارَ الرِّدَّةِ تَوْبَةً إنْ كانت مَقْبُولَةً كما لَا يَخْفَى

الرَّافِضِيُّ إذَا كان يَسُبُّ الشَّيْخَيْنِ وَيَلْعَنُهُمَا وَالْعِيَاذُ بِاَللَّهِ فَهُوَ كَافِرٌ وَإِنْ كان يُفَضِّلُ عَلِيًّا كَرَّمَ اللَّهُ تَعَالَى وَجْهَهُ على أبي بَكْرٍ رضي اللَّهُ تَعَالَى عنه لَا يَكُونُ كَافِرًا إلَّا أَنَّهُ مُبْتَدِعٌ وَالْمُعْتَزِلِيُّ مُبْتَدِعٌ إلَّا إذَا قال بِاسْتِحَالَةِ الرُّؤْيَةِ فَحِينَئِذٍ هو كَافِرٌ كَذَا في الْخُلَاصَةِ وَلَوْ قَذَفَ عَائِشَةَ رضي اللَّهُ تَعَالَى عنها بِالزِّنَا كَفَرَ بِاَللَّهِ وَلَوْ قَذَفَ سَائِرَ نِسْوَةِ النبي صلى اللَّهُ عليه وسلم لَا يَكْفُرُ وَيَسْتَحِقُّ اللَّعْنَةَ وَلَوْ قال عُمَرُ وَعُثْمَانُ وَعَلِيٌّ رضي اللَّهُ عَنْهُمْ لم يَكُونُوا أَصْحَابًا لَا يَكْفُرُ وَيَسْتَحِقُّ اللَّعْنَةَ كَذَا في خِزَانَةِ الْفِقْهِ من أَنْكَرَ إمَامَةَ أبي بَكْرٍ الصِّدِّيقِ رضي اللَّهُ عنه فَهُوَ كَافِرٌ وَعَلَى قَوْلِ بَعْضِهِمْ هو مُبْتَدِعٌ وَلَيْسَ بِكَافِرٍ وَالصَّحِيحُ أَنَّهُ كَافِرٌ وَكَذَلِكَ من أَنْكَرَ خِلَافَةَ عُمَرَ رضي اللَّهُ عنه في أَصَحِّ الْأَقْوَالِ كَذَا في الظَّهِيرِيَّةِ وَيَجِبُ إكْفَارُهُمْ بِإِكْفَارِ عُثْمَانَ وَعَلِيٍّ وَطَلْحَةَ وَزُبَيْرٍ وَعَائِشَةَ رضي اللَّهُ تَعَالَى عَنْهُمْ
