Title: Can one use funds from the Sadaqah Box for ones personal use?

I have kept a sadqa box in which daily we put some little amount in morning one day each kid will put money in it so that kids should leran to spend in path of Allah.We give it some needy person at the end of the month .If some time if we dont have any amount(like end of t he month ) if some urgent basic minimum need arises(happen rarely) in such situation can is it halal/jayaz spend it on my family and children if some need arises when we are in need.

Answer

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

The purpose of the Sadaqah box is to nurture the children to spend in the path of Allah. If that donated money will be used for personal needs and that is observed by the children, then the purpose of the Sadaqah box will be defeated and in fact it may have an adverse effect. The children may tend to think that money donated for the path of Allah may be used for oneself.

While the use of the Sadaqah money is permissible, as spending on one’s family is also Sadaqah, we advise against it. [1]

 وَالصَّدَقَةُ كَالْهِبَةِ - عِنْدَنَا - فِي أَنَّهُ لَا يُوجَبُ الْمِلْكُ لِلْمُتَصَدَّقِ عَلَيْهِ إلَّا بِالْقَبْضِ خِلَافًا لِمَالِكٍ - رَحِمَهُ اللَّهُ -

وَفِي الصَّدَقَةِ خِلَافٌ بَيْن الصَّحَابَةِ، وَمَنْ بَعْدَهُمْ - رَضِيَ اللَّهُ تَعَالَى عَنْهُمْ -، وَكَانَ عَلِيٌّ وَابْنُ مَسْعُودٍ - رَضِيَ اللَّهُ عَنْهُمَا - يَقُولَانِ: إذَا أَعْلَمْت الصَّدَقَةَ جَازَتْ، وَكَانَ ابْنُ عَبَّاسٍ وَمُعَاذٌ - رَضِيَ اللَّهُ عَنْهُمْ - يَقُولَانِ لَا تَجُوزُ الصَّدَقَةُ إلَّا مَقْبُوضَةً. وَعَنْ شُرَيْحٍ وَإِبْرَاهِيمَ النَّخَعِيِّ - رَحِمَهُمَا اللَّهُ تَعَالَى - فِيهِ رِوَايَتَانِ ذَكَرَهُمَا فِي الْكِتَابِ؛ فَأَخَذْنَا بِحَدِيثِ ابْنِ عَبَّاسٍ - رَضِيَ اللَّهُ عَنْهُمَا -، وَحَمَلْنَا قَوْلَ عَلِيٍّ، وَعَبْدِ اللَّهِ بْنِ مَسْعُودٍ - رَضِيَ اللَّهُ عَنْهُمَا - عَلَى صَدَقَةِ الرَّجُلِ عَلَى وَلَدِهِ الصَّغِيرِ، وَذَلِكَ بِالْإِعْلَامِ يَتِمُّ؛ لِأَنَّهُ يَصِيرُ قَابِضًا لَهُ

قال: "والصدقة كالهبة لا تصح إلا بالقبض"؛ لأنه تبرع كالهبة

 

المحيط البرهاني في الفقه النعماني (6/ 264)

الفصل الثاني عشر: في الصدقة

قال محمد رحمه الله في «الأصل» : والصدقة بمنزلة هبة في المشاع وغير المشاع في حاجتها إلى القبض؛ لأنها تبرع كالهبة، قال: إلا أنه لا رجوع في الصدقة إذا تمت، فقد بقي الرجوع في الصدقة مطلقا من غير فصل بينهما إذا كان المتصدق عليه غنيا أو فقيرا، واختلفا المشايخ فيه

(والتمكن من القبض كالقبض فلو وهب لرجل ثيابا في صندوق مقفل ودفع إليه الصندوق لم يكن قبضا) لعدم تمكنه من القبض (وإن مفتوحا كان قبضا لتمكنه منه) فإنه كالتخلية في البيع اختيار وفي الدرر والمختار صحته بالتخلية في صحيح الهبة لا فاسدها وفي النتف ثلاثة عشر عقدا لا تصح بلا قبض
