Title: Sajda Sahw

Question

Assalam o Alaikum wr wb,

My question is regarding Sajdah Sahw.

Sometimes i forget that in 2nd rakat whether i sat for attahyat or not. I remember when i stood for third rakat.

What should i do now? Should i continue with 3rd rakat and perform sajdah sahw at the end or restart the salah?

Answer

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

In principle, to sit for the first tashahhud is wajib. If one leaves this out unintentionally then he will have to make sajdah sahwa at the end of his Salah.[1]

In the enquired situation, you should continue with the third rakat and perform sajdah sahwa in the end.[2]

(سها عن القعود الاول من الفرض) ولو عمليا، أما النفل فيعود ما لم يقيد بالسجدة (ثم تذكره عاد إليه) وتشهد، ولا سهو عليه في الاصح (ما لم يستقم قائما) في ظاهر المذهب، وهو الاصح. فتح (وإلا) أي وإن استقام قائما (لا) يعود لاشتغاله بفرض القيام (وسجد للسهو) لترك الواجب

ومن سها عن القعدة الأولى ثم تذكر وهو إلى حال القعود أقرب عاد فجلس وتشهد وإن كان إلى حال القيام أقرب لم يعد

فتح القدير (3/ 51)

( وَمَنْ سَهَا عَنْ الْقَعْدَةِ الْأُولَى ثُمَّ تَذَكَّرَ وَهُوَ إلَى حَالَةِ الْقُعُودِ أَقْرَبُ عَادَ وَقَعَدَ وَتَشَهَّدَ ) لِأَنَّ مَا يَقْرُبُ مِنْ الشَّيْءِ يَأْخُذُ حُكْمَهُ ، ثُمَّ قِيلَ يَسْجُدُ لِلسَّهْوِ لِلتَّأْخِيرِ .

وَالْأَصَحُّ أَنَّهُ لَا يَسْجُدُ كَمَا إذَا لَمْ يَقُمْ ( وَلَوْ كَانَ إلَى الْقِيَامِ أَقْرَبَ لَمْ يَعُدْ ) لِأَنَّهُ كَالْقَائِمِ مَعْنًى ( يَسْجُدُ لِلسَّهْوِ ) لِأَنَّهُ تَرَكَ الْوَاجِبَ .
