Title

Marry whomsoever you want

Question

Some one told me your wife like some one else .so i said marry where ever you want with out intention of talaq. I said this when i was alone asuming that wife is listening. The only intention was that if you marry some one I don't care. is it talaq word or not if talaq word kinaya or sarih. Please reply me soon. It's urgent JazakAllah

Answer

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

In principle, if the husband utters a word or a statement that has dual or multiple meanings and some of the meanings could mean divorce (talaaq), then divorce will take place only if the husband intended divorce with the word or statement. In that instance, one talaaqe-baain (irrevocable divorce) will take place, which terminates the nikaah immediately.

In the enquired situation, you did not intend divorce. Hence, your nikaah is still valid. [1]
