Title: Temporary Marriage

Question

assalamu alaykom! what is your fatwa on temporary marriage?

Answer

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

Temporary marriage (mut’ah) is not permissible in Islam.

Mut’ah was permissible in the early stages of Islam and thereafter abbrogated.[1]  

Ali (رضى الله عنه) narrates,

عَنْ عَلِيٍّ رَضِيَ اللَّهُ عَنْهُ قَالَ: «نَهَى رَسُولُ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ عَنِ المُتْعَةِ عَامَ خَيْبَرَ...»

"Rasulullah (صلى الله عليه وسلم) prohibited us from mut’ah in the year of Khaibar..."[2]

عَنْ رَبِيعِ بْنِ سَبْرَةَ، عَنْ أَبِيهِ، أَنَّ النَّبِيَّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ «حَرَّمَ مُتْعَةَ النِّسَاءِ»

In another narration, Rabi’ ibn Sabrah narrates from his father that Nabi (صلى الله عليه وسلم) banned (made haram) mut’ah.[3]

قَالَ ( وَنِكَاحُ الْمُتْعَةِ بَاطِلٌ ) وَهُوَ أَنْ يَقُولَ لِامْرَأَةٍ أَتَمَتَّعُ بِك كَذَا مُدَّةً بِكَذَا مِنْ الْمَالِ وَقَالَ مَالِكٌ رَحِمَهُ اللَّهُ هُوَ جَائِزٌ لِأَنَّهُ كَانَ مُبَاحًا فَيَبْقَى إلَى أَنْ يَظْهَرَ نَاسِخُهُ .قُلْنَا ثَبَتَ النَّسْخُ بِإِجْمَاعِ الصَّحَابَةِ رَضِيَ اللَّهُ تَعَالَى عَنْهُمْ وَابْنُ عَبَّاسٍ رَضِيَ اللَّهُ عَنْهُمَا صَحَّ رُجُوعُهُ إلَى قَوْلِهِمْ فَتَقَرَّرَ الْإِجْمَاعُ .

نكاح المتعة باطل لا يفيد الحل ولا يقع عليها طلاق ولا إيلاء ولا ظهار ولا يرث أحدهما من صاحبه هكذا في فتاوى قاضي خان
