Title: Misc. questions about divorce and maintenance

Question

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh

 

I hope this message reach you in good faith, insha'allah. My question regrading when a husband's wife leaves her home for very long time and did not return, is this considered to be a divorce? Does the man have to take care of her when she has his children with her  or taken from him? From my knowledge, if husband divorce his wife, he has to take care her and the children. However, what is the circumstances when she is seeking kolal, but he doesn not want to give the kolal?

Answer

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

1. In principle, being separated from the husband for any period of time without the husband having issued divorce (Talāq), does not constitute a divorce. The nikah remains intact.1 

2. A wife is entitled to nafaqah (maintenance) when she is staying with her husband. If she separates herself from her husband, she is not entitled to nafaqah. The father has to always maintain his minor children and adult daughters until marriage. 2

 

3. Khula is when the wife offers to return her mahr in exchange of the talaq. If the husband agrees on the khula, that will constitute a talaaq-e-bain. If he does not agree on the khula, the khula cannot take place.

وَهُوَ أَنْ تَفْتَدِيَ الْمَرْأَةُ نَفْسَهَا بِمَالٍ لِيَخْلَعَهَا بِهِ، فَإِذَا فَعَلَا لَزِمَهَا الْمَالُ وَوَقَعَتْ تَطْلِيقَةٌ بَائِنَةٌ،
