Title: Does this statement affect my marriage?

Question

Once in one of the marriage my wife was not in hijab. I was advising her in the marriage day to be in hijab or atleast try to stay away from people where there are more gents in a polite way. Also i said that i am follwing sunnah in my appearance n attire , i feel shame that my wife is without hijab. For that she replied, then plz don sit with me so that they(others) may think that i am not your wife. This made me angry and said her as you said 'jaisa app bole aaj tume mere bhievi ny' and I gone from that place. She too cried n went from that place. then on the same day i asked her sorry for saying like that. will this affect our marriage.

Answer

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

The statement ‘ jaisa app bole aaj tu mere bhievi ny’ is in response to the wife’s statement in which she said ‘ don sit with me so that they (others) may think I  am not your wife’. Accordingly, he said jaisa app bole which means; as you said… The similarity is in merely being separate so that people may think that they are not husband and wife. The purpose was not to issue talaq.

However, if the husband intended talaq, then one talaq raj’i(revocable) divorce will take place.[1]

والطلاق على ضربين: صريح وكناية فالصريح قوله: أنت طالق… ولا يفتقر إلى النية

والضرب الثاني: والكنايات ولا يقع بها الطلاق إلا بينة أو دلاله حال

 

 

اللباب في شرح الكتاب (4/ 102) 

(والضرب الثاني الكنايات) وهي: مالم يوضع له واحتمله وغيره (ولا يقع بها الطلاق إلا بنية أو دلالة حال) من مذاكرة الطلاق، أو وجود الغضب لأنها غير موضوعة للطلاق، بل تحتمله وغيره، فلابد من التعيين أو دلالته، لأن الطلاق لا يقع بالاحتمال

 

اللباب في شرح الكتاب (4/-105 103) 

وهي(أي ألفاظ الكنايات) على ضربين منها ثلاثة ألفاظٍ يقع بها الطلاق الرجعي ولا يقع بها إلا واحدةٌ وهي قوله: اعتدى، واستبرئي رحمك وأنت واحدةٌ، وبقية الكنايات إذا نوى بها الطلاق كانت واحدةً بائنةً، وإن نوى بها ثلاثاً كانت ثلاثاً، وإن نوى اثنتين كانت واحدةً، وهذا مثل قوله: أنت بائنٌ، وبتةٌ، وبتلةٌ، وحرامٌ، وحبلك على غاربك، والحقي بأهلك، وخليةٌ، وبريةٌ، ووهبتك لأهلك، وسرحتك، وفارقتك، وأنت حرةٌ، وتقنعي، وتخمري، واستتري، واعزبي، واغربي، وابتغي الأزواج ، فإن لم يكن له نية لم يقع بهذه الألفاظ طلاقٌ، إلا أن يكونا في مذاكرة الطلاق، فيقع بها الطلاق في القضاء، ولا يقع فيما بينه وبين الله تعالى إلا أن ينويه
