Title: Spending on parents


Assalamu alaikum

I have 2 questions:

1. Before Marriage, If a Son earns and give it to his Paraents for thier use and Paraents use that money for marriage of his daughters ( for sister marriage) .Son has no objection to what ever way his parents use the money that he has Provided. . Is this allowed in Islam? Does Islam restricts paraents to use  his son's money for spending over to Daughters. 

2. After the son getting married , He sends money to his paraents for thier use and sameway parents use that money for daughters ( for Sister) , Son has no objection to what ever way his parents use the money that he has Provided. . But wife is objecting to this and telling Parents should not use sons money for thier daughters ( For sister) , This is not allowed in Islam. The son is taking care of his wife and Kids. Sending money for his parents / for Sisters may reduce the saving potential of the son and he is ok with that but not the wife. What the ruling of islam on this regard?.


Who has financial right of earning . Is this the person who is earning ( male ) or his wife or his paraents?.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

1)     The money is considered a gift. The parents can use the money as they please especially if the son has no objection.

2)     The money is the sole ownership of the person who earns it. Therefore, in the enquired case, the husband has the right over the money he is earning. He may do as he pleases with the money within the bounds of Shariah. [i]

ثم الكسب على مراتب، فمقدار ما لابد لكل أحد منه يعني ما يقيم به صلبه يفترض على كل أحد اكتسابه ههنا؛ وكذلك إذا كان له عيال من زوجة، وأولاد صغار، فإنه يفترض عليه الكسب بقدر كفايتهم عيناً؛ لأن نفقة الزوجة مستحقة على الزوج، وكذلك نفقة الولد مستحقة على الوالد، ولا يتوصل إليها إلا بالكسب، فصار الكسب مستحقاً عليه، وكذلك إذا كان له أبوان معسران يفترض عليه الكسب بقدر كفايتهما؛ لأن نفقتهما فرض عليه، وما زاد على قدر كفايته وكفاية عياله مباح إذا لم يرد به الفخر والرياء.

(ولا يشارك الولد في نفقة أبويه أحد) ، لأن لهما تأويلاً في مال الولد بالنص، ولأنه أقرب الناس إليهما. بحر. وهي على الذكور والإناث بالسوية في ظاهر الرواية، وهو الصحيح، لأن المعنى يشملهما، هداية. قال في التصحيح: وهو أظهر الروايتين عن أبي حنيفة، وبه أخذ الفقيه أبو الليث، وبه يفتي، واحترز به عن رواية الحسن عن أبي حنيفة أنها بين الذكور والإناث ثلاثا. اهـ.
