Title: Income from insurance broker

Question

I am living in joint family.my husband income is halal but I am not sure about my father in-law whether his income is halal or not as he is working in insurance broker company and most of ulema said that it is not permissible to work in insurance broker. My husband gives some amount of money for kitchen grocery and for paying bills and my father in law also gives money for kitchen grocery and bills etc My question is that is halal or haram money is mixing? Is it permissible for me and my children to consume that food and other things like electricity,gas etc as my husband is giving an estimated amount of money from our side for consuming food and other things? What ruling about gifts and chocolates which my father in law give to my children? I am in so much stress about thinking this matter that whether we are consuming halal or haram and we cannot separate my kitchen and other things as my husband is only son of my father in law and my father in law has also two un married daughter for whom he did not agree to leave his job Please reply as soon as possible..Jazak allah

Answer

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

If your husband’s source of income is halal and he is contributing to the groceries and bills with his income, then your consumption of anything will be attributed to your husband’s halal income.[1]

Your husband may contribute extra for the chocolates and sweets your father in law buys for his grandchildren. That too will be attributed to your husband’s halal income.

وفي الخانية امرأة زوجها في أرض الجور إن أكلت من طعامه ولم يكن عين ذلك الطعام غصبا فهي في سعة من أكله وكذا لو اشترى طعاما أو كسوة من مال أصله ليس بطيب فهي في سعة من تناوله الإثم على الزوج ا هـ

قال أبو بكر البلخي جاز لعرسه وعياله أن يأكلوا من طعامه ويلبسوا ثيابه ويسكنوا في منزله إن لم يكن عين الطعام والثياب والمنزل مغصوبة وكل ما جمعه لوارث والإثم على المكتسب

آكل الربا و كاسب الحرام اهدى اليه أو أضافه و غالب ماله حرام لا يقبل ولا يأكل مالم يخبره أن ذلك المال أصله حلال ورثه او استقرضه. وان كان غالب ماله حلالا لا بأس بقبول هديته والأكل منها كذا في الملتقط.

ولو أن رجلاً أهدى إليه إنسان يكتسب من ربا أو رجل ظالم يأخذ أموال الناس أو اضافة فإن كان غالب ماله من حرام فلا ينبغي له أن يقبل ولا يأكل من طعامه ما لم يخبره أن ذلك المال أصله حلال ورثه أو استقرضه أو نحو ذلك. فإن كان غالب ماله حلال فلا بأس بأن يقبل هديته ويأكل منه ما لم يتبين عنده أنه من حرام.

مجمع الأنهر في شرح  ملتقى الأبحر (2/ 529)

وَفِي الْبَزَّازِيَّةِ غَالِبُ مَالِ الْمُهْدِي إنْ حَلَالًا لَا بَأْسَ بِقَبُولِ هَدِيَّتِهِ وَأَكْلِ مَالِهِ مَا لَمْ يَتَبَيَّنْ أَنَّهُ مِنْ حَرَامٍ؛ لِأَنَّ أَمْوَالَ النَّاسِ لَا يَخْلُو عَنْ حَرَامٍ فَيُعْتَبَرُ الْغَالِبُ وَإِنْ غَالَبَ مَالَهُ الْحَرَامُ لَا يَقْبَلُهَا وَلَا يَأْكُلُ إلَّا إذَا قَالَ إنَّهُ حَلَالٌ أُورِثْتُهُ وَاسْتَقْرَضْتُهُ وَلِهَذَا قَالَ أَصْحَابُنَا لَوْ أَخَذَ مُورِثُهُ رِشْوَةً أَوْ ظُلْمًا إنْ عَلِمَ وَارِثُهُ ذَلِكَ بِعَيْنِهِ لَا يَحِلُّ لَهُ أَخْذُهُ وَإِنْ لَمْ يَعْلَمْهُ بِعَيْنِهِ لَهُ أَخَذَهُ حُكْمًا لَا دِيَانَةً فَيَتَصَدَّقُ بِهِ بِنِيَّةِ الْخُصَمَاءِ.
