Title: Equality between wives



I have two wives and both live in separate houses. My first wife wants that Mastoorat (Female) Tablighi Jamat of three days stay in her house. Besides it, she asked her nights back, which I have spent in these days in the house of my 2nd wife.

2nd wife refuses to return these nights and say that I don’t have asked her to call Jamat. If she want Jamat, she can call them, but I cannot return nights back.

Situation is that when Jamat came I mostly remain with them and go to 2nd wife for a little time in day time and I go to her for just sleeping in night.

One possible solution of it, was to give their nights to both of them, meaning I sleep in the house of whose night it is. But in this situation 2nd wife raises issue that Jamat is in the 1st one’s home and you are giving most of the time to Jamat and there is no time left for me, and you have passed all my holiday time there with Jamat. Please guide who is right and who is wrong and what should I do in this situation.

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

The solution proposed by you is correct. Spend the night in the house of the wife who’s turn it is regardless of where the Jamat is. B’s objection of you spending the day with the Jamat is invalid. The right of equality applies to night only and not in the day. However, you may consider taking out some time from the Jamat and spending time with B in the day.[i]

مجمع الأنهر في شرح ملتقى الأبحر (1/ 374)

(وإن وهبت قسمها لضرتها صح) والهبة هنا مجاز عن العطية (ولها) أي للواهبة (أن ترجع) عن هبتها

في المستقبل؛ لأنها أسقطت حقا لم يجب بعد فلا يسقط، وفيه إشعار بأنها لو جعلت لزوجها مالا أو حطته من مهرها ليزيد قسمها كان لها الرجوع بما أعطته، وكذا لو زاد الزوج في مهرها ليجعل يومها لغيرها لأنه رشوة وهي حرام كما في العناية.


مختصر القدوري (ص: 151)

وإذا كان للرجل امرأتان حرتان فعليه أن يعد بينهما في القسم بكرين كانتا أو ثيبتين أو إحداهما بكرا والأخرى ثيبا

وإن كانت إحداهما والأخرى أمة فللحرة الثلثان من القسم وللأمة الثلث

ولا حق لهن في القسم حالة السفر ويسافر الزوج بمن شاء منهن والأولى أن يفرغ بينهن فيسافر بمن خرجت قرعتها وإن رضيت الزوجات بترك قسمها لصاحبتها جاز ولها أن ترجع في ذلك

(يجب) وظاهر الآية أنه فرض نهر (أن يعدل) أي أن لا يجور (فيه) أي في القسم

بالتسوية في البيتوتة (وفي الملبوس والمأكول) والصحبة (لا في المجامعة) كالمحبة بل يستحب


درر الحكام شرح غرر الأحكام (1/ 355)

(ولها أن ترجع إن تركت قسمها لأخرى) ؛ لأنها أسقطت حقا لم يجب بعد فلا يسقط؛ لأن الإسقاط إنما يكون في القائم، فيكون الرجوع امتناعا بمنزلة العارية حيث يرجع المعير فيها متى شاء لما قلنا (ولا يسقط بمرضها) والله أعلم
