Title

Pants below the ankles

Question

Assamualaikum Wa rahmatullahi wa barakatuh,

I am a 24 year old ppharmacy student. I really like this girl who went to the same school as me for last 3 years. I am planning on marrying her and I already told my family that I like this girl and they too already have met the girl in person. There are 2 problems- 1. The girl is hyderabadi and  I am a gujarati so it took a lot to convince my family to at least meet the girl and which they did and they also liked her. 2. My parents do not live with me  because my dad has a business in India so my mom and dad lives in India therefore it's hard for me to get my nikah done without them. But my parents did see her pics and liked her as well. What I am thinking about right now is that I want to do secret nikah with her so I can make it halal because my family and her family is not ready for us to get married for another 2 years when I will finish my school. I tried to explain that we can atleast do nikah and rukshati later but they're not agreeing to it which is why I decided to do secret nikah. Should I go head with this decision because it is very hard for me and her to keep distance. We used to talk a lot but then we realized that it is not right untill we get our nikah done. Now I am very depressed as I don't get to talk to her. JazakAllah khair. 

Answer

In the name of Allah, Most Gracious, Most Merciful 
As-salaamu ‘alaykum wa-rahmatullaahi wa-barakaatuh

It is not permissible to wear garments that goes beyond the ankles. The prohibition is for all times, in Salah and out of Salah.[i]

See the following Hadith:

قال رسول الله صلى الله عليه وسلم‏:‏ ‏ "‏إزارة المسلم إلى نصف الساق، ولا حرج - أو لا جناح - فيما بينه وبين الكعبين، فما كان أسفل من الكعبين فهو في النار، ومن جر إزاره بطرا لم ينظر الله إليه (سنن ابي داود: 4093)

Translation: Rasulullah (Sallallahu Alaihi Wasallam) said, "The lower garment of a believer should be half way below the knees. He is guilty of no sin if they are up to the ankles. That which is below the ankles is in the Fire (of Hell). Allah will not look at one who allows his lower garment to trail out of vanity. (Abu Dawud: 4093)

عَنْ أَبِي هُرَيْرَةَ، أَنَّ رَسُولَ اللَّهِ صلى الله عليه وسلم قَالَ ‏"‏لاَ يَنْظُرُ اللَّهُ يَوْمَ الْقِيَامَةِ إِلَى مَنْ جَرَّ إِزَارَهُ بَطَرًا ‏"‏‏(صحيح بخاري: 5788 (

Translation: Rasulullah (Sallallahu Alaihi Wasallam said, "Allah will not look, on the Day of Resurrection, at a person who drags his Izar (behind him) out of pride and arrogance. (Sahih al-Bukhari: 5788)

If the trouser is below the ankles, you should fold it and bring it above the ankles.

عَنِ ابْنِ عُمَرَ قَالَ: مَرَرْتُ عَلَى رَسُولِ اللَّهِ - صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ - وَفِي إِزَارِي اسْتِرْخَاءٌ) : أَيِ اسْتِنْزَالٌ (فَقَالَ: يَا عَبْدَ اللَّهِ! ارْفَعْ إِزَارَكَ " فَرَفَعْتُهُ، ثُمَّ قَالَ: " زِدْ) : أَيْ فِي الرَّفْعِ (فَزِدْتُ) : أَيْ فَسَكَتَ - صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ - (فَمَا زِلْتُ أَتَحَرَّاهَا) : أَيْ أَتَحَرَّى الْفِعْلَةَ وَهِيَ رَفْعُ الْإِزَارِ شَيْئًا فَشَيْئًا. ذَكَرَهُ الطِّيبِيُّ. وَالظَّاهِرُ أَنَّ الضَّمِيرَ رَاجِعٌ إِلَى الرَّفْعَةِ الْأَخِيرَةِ، وَالْمَعْنَى دَائِمًا أَجْتَهِدُ وَأَبْذُلُ الْجُهْدَ عَلَى أَنْ يَكُونَ رَفْعُ إِزَارِي عَلَى وَفْقِ تَقْرِيرِهِ - صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ - (بَعْدُ) : مَبْنِيٌّ عَلَى الضَّمِّ أَيْ بَعْدَ قَوْلِ النَّبِيِّ - صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ - ارْفَعْ " ثُمَّ " زِدْ " (فَقَالَ بَعْضُ الْقَوْمِ: إِلَى أَيْنَ؟) : أَيْ رَفَعْتَهُ فِي الْمَرَّةِ الْأَخِيرَةِ (قَالَ: إِلَى أَنْصَافِ السَّاقَيْنِ. رَوَاهُ مُسْلِمٌ) . وَفِي الشَّمَائِلِ، «عَنْ عُبَيْدِ بْنِ خَالِدٍ الْمُحَارِبِيِّ قَالَ: بَيْنَمَا أَنَا أَمْشِي بِالْمَدِينَةِ إِذْ إِنْسَانٌ خَلْفِي يَقُولُ: ارْفَعْ إِزَارَكَ ; فَإِنَّهُ أَتْقَى. وَفِي رِوَايَةٍ: أَنْقَى بِالنُّونِ وَأَبْقَى بِالْمُوَحَّدَةِ، فَالْتَفَتُّ، فَإِذَا هُوَ رَسُولُ اللَّهِ - صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ - فَقُلْتُ: يَا رَسُولَ اللَّهِ! إِنَّمَا هِيَ بُرْدَةٌ مَلْحَاءُ، قَالَ: " أَمَّا لَكَ فِيَّ أُسْوَةٌ؟ " فَنَظَرْتُ، فَإِذَا إِزَارُهُ إِلَى نِصْفِ سَاقَيْهِ» . وَعَنْ سَلَمَةَ بْنِ الْأَكْوَعِ قَالَ: «كَانَ عُثْمَانُ بْنُ عَفَّانَ يَأْتَزِرُ إِلَى أَنْصَافِ سَاقَيْهِ، وَقَالَ: هَكَذَا كَانَتْ إِزْرَةَ صَاحِبِي، يَعْنِي النَّبِيَّ - صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ» - وَعَنْ حُذَيْفَةَ قَالَ: «أَخَذَ رَسُولُ اللَّهِ - صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ - بِعَضَلَةِ سَاقِي أَوْ سَاقِهِ فَقَالَ: " هَذَا

مَوْضِعُ الْإِزَارِ، فَإِنْ أَبَيْتَ فَأَسْفَلُ، فَإِنْ أَبَيْتَ فَلَا حَقَّ لِلْإِزَارِ فِي الْكَعْبَيْنِ» " هَذَا وَقَدْ سَبَقَ فِي الْحَدِيثِ الصَّحِيحِ: " مَا أَسْفَلَ مِنَ الْكَعْبَيْنِ مِنَ الْإِزَارِ فِي النَّار

حَدَّثَنَا قُتَيْبَةُ قَالَ: حَدَّثَنَا أَبُو الأَحْوَصِ، عَنْ أَبِي إِسْحَاقَ، عَنْ مُسْلِمِ بْنِ نُذَيْرٍ، عَنْ حُذَيْفَةَ قَالَ: أَخَذَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ بِعَضَلَةِ سَاقِي، أَوْ سَاقِهِ، فَقَالَ: «هَذَا مَوْضِعُ الإِزَارِ، فَإِنْ أَبَيْتَ فَأَسْفَلَ، فَإِنْ أَبَيْتَ فَلَا حَقَّ لِلإِزَارِ فِي الكَعْبَيْنِ»

والثالث كل لباس يكون على خلاف السنة يكون لبسه مكروها وهو مثل أثواب الكفار واثواب الفسق والفجور وأهل الاشر والبطر مثل القرطق واسبال الازار

 

الفتاوى الهندية (43/ 183)

وإسبال الإزار والقميص بدعة ينبغي أن يكون الإزار فوق الكعبين إلى نصف الساق وهذا في حق الرجال
