Title: Zakaat on debt

Question

Assalamu Aleykum

My question is about Zakat Al Mal.

I made a loan of $20,000 from a bank (No interest).

I have a salary of $7500 / month. I pay the bank monthly. But when I pay my loan to the bank (monthly) I make sure my balance in my checking account is above a certain amount (~$500) just to be safe not to fall in negative balance. The $500 are above the Nissab. Should I pay my Zakat for $500 if they make the full cycle? knowing that I still owe the bank way above what I have in my checking account.

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

In principle, a person will be liable to give Zakat when one’s wealth reaches the Nisaab (threshold with which one will be liable to give Zakat).[i] The Nisaab is 87.479 grams of gold and 612.35 grams of silver, or its equivalent in cash.[ii] Thereafter, the following year, on the same date of the lunar calendar, one will have to give Zakat if one has Zakatable assets equivalent to the Nisaab on that date each year.[iii] Zakat will be liable on gold and silver, cash in hand and trading stock

Long term loans do not prevent the obligation of Zakat whereas short term loans prevent the obligation of Zakat. Therefore, if someone is paying off a long-term debt such as a mortgage, then the debt of one year will be exempt from Zakat. For example, if someone is repaying a mortgage and pays $5000 annually, then this amount is exempt from Zakat.[iv]

In the enquired situation, if you have cash in hand which is more than the Nisaab on your annual date of Zakat, then you will deduct the short-term debts (those which will be paid in one year) from your cash in hand. Thereafter if you still have the Nisaab amount, then you will pay Zakat on that amount.

الزكاة واجبة في عروض التجارة كائنة ما كانت إذا بلغت قميتها نصابا من الذهب أو الورق يقومها بما هو أنفع للفقراء والمساكين منهما

وإذا كان النصاب كاملا في طرفي الحول فنقصانه فيما بين ذلك لا يسقط الزكاة

وتضم قيمة العروض إلى الذهب والفضة وكذلك يضم الذهب إلى الفضة بالقيمة حتى يتم النصاب عند أبي حنيفة

أما القاضي صدر الدين فهو صدر الأئمة والدين القاضي أبو المعالي بن أبي اليسر البزدوي، واسمه أحمد بن محمد البزدوي البخاري، المعروف بقاضي الصدر و القاضي صدر الدين، توفي بسرخس سنة 542هـ
