Title: Do adoptive children have to cover in front of their adoptive parents?


Can Mufti saheb please explain the masaail and laws pertaining to adopting a female child that is below 2 years old. Will she have to make pardah from her adoptive father once she reaches puberty if breastfed by the adoptive mother? 


In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu alaykum wa-rahmatullāhi wa-barakātuh.

If the female child was breastfed by the adoptive mother before 30 months of age (2 and a half years), she will not have to make pardah from her adoptive father when she attains puberty.[1] If the child was not breastfed by the adoptive mother before 30 months of age, the rulings of hijab will apply.

[1] ثُمَّ إنَّمَا تَثْبُتُ الْحُرْمَةُ مِنْ جَانِبِ الزَّوْجِ إذَا كَانَ لَهَا زَوْجٌ، فَأَمَّا إذَا لَمْ يَكُنْ لَهَا زَوْجٌ بِأَنْ وَلَدَتْ مِنْ الزِّنَا فَنَزَلَ لَهَا لَبَنٌ فَأَرْضَعَتْ بِهِ صَبِيًّا فَالرَّضَاعُ يَكُونُ مِنْهَا خَاصَّةً لَا مِنْ الزَّانِي؛ لِأَنَّ نَسَبَهُ يَثْبُتُ مِنْهَا لَا مِنْ الزَّانِي وَالْأَصْلُ أَنَّ كُلَّ مَنْ يَثْبُتُ مِنْهُ النَّسَبُ يَثْبُتُ مِنْهُ الرَّضَاعُ وَمَنْ لَا يَثْبُتُ مِنْهُ النَّسَبُ لَا يَثْبُتُ مِنْهُ الرَّضَاعُ، وَكَذَا الْبِكْرُ إذَا نَزَلَ لَهَا لَبَنٌ وَهِيَ لَمْ تَتَزَوَّجْ قَطُّ؛ فَالرَّضَاعُ يَكُونُ مِنْهَا خَاصَّةً وَاَللَّهُ الْمُوَفِّقُ

وَأَمَّا الْحُرْمَةُ فِي جَانِبِ زَوْجِ الْمُرْضِعَةِ الَّتِي نَزَلَ لَهَا مِنْهُ لَبَنٌ فَثَبَتَتْ عِنْدَ عَامَّةِ الْعُلَمَاءِ وَعَامَّةِ الصَّحَابَةِ - رَضِيَ اللَّهُ عَنْهُمْ

وحرمت السنة الابنة من الرضاعة وولد الابنة وان سفل

ومن جھة النظر: ان وطء الرجل لما کان منہ الولادة، صار سببا لنزول اللبن الموجب للتحریم، فوجب ان یتعلق حکم التحریم بالرجل کھو فی المرأة

واما وجہ تقدیر ستة اشہر بعد الحولین، فان طریقہ الاجتہاد وذلک لانہ قد ثبت ان رضاع الکبیر لا یحرم، وان الزیادة علی الحولین تحرم للدلائل التی قدمنا۔۔۔وحملہ وفصلہ ثلثون شہرا
