Title: Does Hurmate Musaharah take place because of two sisters?

Question

Salaam I am a brother emailin you on behalf of a sister, who has trusted me enough to seek advise on her behalf from u. She has been muslim all her life, but did not practise until a couple of years ago She said she comitted something major when she was younger - did wrong things (lustful) with her own SISTER when they were young (already baaligh). I didnt ask too much because It was an awkward situation and I felt awkward, but she messaged me with trusted, as she didnot know where to get help from. I cud have asked my local mufti but it would be abit awkward for me, Hence I have emailed u She said there is a ruling caled "Harma Musahra" and she fears the lustful things she did with her sister , may have destroyed her mums and dads marriage years ago. I looked it up for her and it said harma musahra only applies between men and women. I told her this, and she said she fears that may not be the case here, so to seek advise from u. She says she is getting suicidal thoughts and is extremely depresed because of this. I have told her i wil get back to her as soon as. So if you could provide me with an answer that I can forward to her, so that she does not do anythin dangerous 2) also is it wrong of me to reply to sisters if they genuinely need help regarding issues?

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

Dear Brother,

It is not permissible to unnecessarily communicate with females that are ghair mahram (not prohibited in marriage). If there is a genuine need as in the case of reference seeking advice on Shariah, one may assist to the extent of the need and ensure that all avenues of fitnah are closed. Shaitan also uses Deen to mislead people and make them follow their nafs and desires.

Your understanding of hurmate musaharah is correct. It takes place only between males and females, not between females. However, the immoral relationship between females is haram and a sinful act for which tawbah and istighfaar should be made.

قَوْلُهُ حَرُمَ مِنَ النَّسَبِ سَبْعٌ وَمِنَ الصِّهْرِ سَبْعٌ فِي رِوَايَة بن مهْدي عَن سُفْيَان عِنْد الْإِسْمَاعِيلِيِّ حَرُمَ عَلَيْكُمْ وَفِي لَفْظٍ حَرُمَتْ عَلَيْكُمْ قَوْله ثمَّ قَرَأَ حرمت عَلَيْكُم امهاتكم الْآيَةَ فِي رِوَايَةِ يَزِيدَ بْنِ هَارُونَ عَنْ سُفْيَانَ عِنْدَ الْإِسْمَاعِيلِيِّ قَرَأَ الْآيَتَيْنِ وَإِلَى هَذِهِ الرِّوَايَةِ أَشَارَ الْمُصَنِّفُ بِقَوْلِهِ فِي التَّرْجَمَةِ إِلَى عَلِيمًا حَكِيمًا فَإِنَّهَا آخِرُ الْآيَتَيْنِ وَوَقَعَ عِنْدَ الطَّبَرَانِيّ من طَرِيق عُمَيْر مولى بن عَبَّاس عَن بن عَبَّاسٍ فِي آخِرِ الْحَدِيثِ ثُمَّ قَرَأَ حُرِّمَتْ عَلَيْكُم امهاتكم حَتَّى بلغ وَبَنَات الْأَخ وَبَنَات الْأُخْت ثُمَّ قَالَ هَذَا النَّسَبُ ثُمَّ قَرَأَ وَأُمَّهَاتُكُمُ اللَّاتِي ارضعنكم حَتَّى بلغ وَأَن تجمعُوا بَين الاختين وَقَرَأَ وَلَا تَنْكِحُوا مَا نَكَحَ آبَاؤُكُمْ مِنَ النِّسَاء فَقَالَ هَذَا الصِّهْرُ انْتَهَى

م: (قال: فإن كان لا يأمن الشهوة لا ينظر إلى وجهها) ش: أي قال القدوري والحاصل أن الذي ذكره من جواز النظر إلى وجه الأجنبية وكفيها إذا أمن الشهوة لِقَوْلِهِ تَعَالَى: {وَلَا يُبْدِينَ زِينَتَهُنَّ إِلَّا مَا ظَهَرَ مِنْهَا} [النور: 31] ، وأما إذا لم يأمن الشهوة لم يجز النظر إلى وجهها أيضا ولا إلى كفيها

والأصل في هذا أن «المرأة عورة مستورة» لقوله - عليه الصلاة والسلام - «المرأة عورة مستورة إلا ما استثناه الشرع وهما عضوان» ولأن المرأة لا بد لها من الخروج للمعاملة مع الأجانب فلا بد لها من إبداء الوجه لتعرف فتطالب بالثمن ويرد عليها بالعيب ولا بد من إبداء الكف للأخذ والعطاء وهذا يفيد أن القدم لا يجوز النظر إليه وعن الإمام أنه يجوز ولا ضرورة في إبداء القدم فهو عورة في حق النظر وليس بعورة في حق الصلاة كذا في المحيط وعن الثاني يجوز النظر إلى ذراعيها أيضا؛ لأنه يبدو منها عادة وما عدا هذه الأعضاء لا يجوز النظر إليها لقوله - عليه الصلاة والسلام - «من نظر إلى محاسن امرأة أجنبية عن شهوة صب في عينيه الآنك يوم القيامة» الحديث وهو الرصاص المذاب
